| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 1701.3545, Occupations Code, is amended |
|---|
| 11 | 11 | | by adding Subsection (b-1) and amending Subsections (e) and (f) to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (b-1) In addition to the requirements of Subsection (b), |
|---|
| 14 | 14 | | each constable must complete at least 20 hours of continuing |
|---|
| 15 | 15 | | education instruction on civil process as part of the continuing |
|---|
| 16 | 16 | | education program provided by the selected institution under this |
|---|
| 17 | 17 | | section during each 48-month continuing education training period. |
|---|
| 18 | 18 | | The commission by rule shall establish minimum curriculum |
|---|
| 19 | 19 | | requirements for the continuing education course on civil process |
|---|
| 20 | 20 | | required by this subsection. The commission may waive the |
|---|
| 21 | 21 | | continuing education requirements of this subsection if: |
|---|
| 22 | 22 | | (1) a constable requests a waiver because of hardship; |
|---|
| 23 | 23 | | and |
|---|
| 24 | 24 | | (2) the commission determines that a hardship exists. |
|---|
| 25 | 25 | | (e) The institution selected under Subsection (a) by rule |
|---|
| 26 | 26 | | may provide for the waiver of: |
|---|
| 27 | 27 | | (1) all or part of the required 40 hours of initial |
|---|
| 28 | 28 | | training for new constables to the extent the new constable has |
|---|
| 29 | 29 | | satisfactorily completed equivalent training during the 24 months |
|---|
| 30 | 30 | | preceding the individual's appointment or election; or |
|---|
| 31 | 31 | | (2) the continuing education requirements of |
|---|
| 32 | 32 | | Subsection (b) or (b-1) for an individual who has satisfactorily |
|---|
| 33 | 33 | | completed equivalent continuing education during the preceding 24 |
|---|
| 34 | 34 | | months. |
|---|
| 35 | 35 | | (f) An individual who is subject to the continuing education |
|---|
| 36 | 36 | | requirements of Subsections [Subsection] (b) and (b-1) is exempt |
|---|
| 37 | 37 | | from other continuing education requirements under this |
|---|
| 38 | 38 | | subchapter. |
|---|
| 39 | 39 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 40 | 40 | | of this Act, the Texas Commission on Law Enforcement shall adopt |
|---|
| 41 | 41 | | rules necessary to implement Section 1701.3545, Occupations Code, |
|---|
| 42 | 42 | | as amended by this Act. |
|---|
| 43 | 43 | | SECTION 3. This Act takes effect September 1, 2017. |
