55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to continuing education training on civil process for
88 constables.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1701.3545, Occupations Code, is amended
1111 by adding Subsection (b-1) and amending Subsections (e) and (f) to
1212 read as follows:
1313 (b-1) In addition to the requirements of Subsection (b),
1414 each constable must complete at least 20 hours of continuing
1515 education instruction on civil process as part of the continuing
1616 education program provided by the selected institution under this
1717 section during each 48-month continuing education training period.
1818 The commission by rule shall establish minimum curriculum
1919 requirements for the continuing education course on civil process
2020 required by this subsection. The commission may waive the
2121 continuing education requirements of this subsection if:
2222 (1) a constable requests a waiver because of hardship;
2323 and
2424 (2) the commission determines that a hardship exists.
2525 (e) The institution selected under Subsection (a) by rule
2626 may provide for the waiver of:
2727 (1) all or part of the required 40 hours of initial
2828 training for new constables to the extent the new constable has
2929 satisfactorily completed equivalent training during the 24 months
3030 preceding the individual's appointment or election; or
3131 (2) the continuing education requirements of
3232 Subsection (b) or (b-1) for an individual who has satisfactorily
3333 completed equivalent continuing education during the preceding 24
3434 months.
3535 (f) An individual who is subject to the continuing education
3636 requirements of Subsections [Subsection] (b) and (b-1) is exempt
3737 from other continuing education requirements under this
3838 subchapter.
3939 SECTION 2. As soon as practicable after the effective date
4040 of this Act, the Texas Commission on Law Enforcement shall adopt
4141 rules necessary to implement Section 1701.3545, Occupations Code,
4242 as amended by this Act.
4343 SECTION 3. This Act takes effect September 1, 2017.
