66 AN ACT
77 relating to a revocable deed that transfers real property at the
88 transferor's death.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 114.103(a), Estates Code, is amended to
1111 read as follows:
1212 (a) Except as otherwise provided in the transfer on death
1313 deed, this section, or any other statute or the common law of this
1414 state governing a decedent's estate, on the death of the
1515 transferor, the following rules apply to an interest in real
1616 property that is the subject of a transfer on death deed and owned
1717 by the transferor at death:
1818 (1) if the designated beneficiary survives the
1919 transferor by 120 hours, the interest in the real property is
2020 transferred to the designated beneficiary in accordance with the
2121 deed;
2222 (2) the share [interest] of any [a] designated
2323 beneficiary that fails to survive the transferor by 120 hours
2424 lapses, notwithstanding Section 111.052, and is subject to and
2525 passes in accordance with Subchapter D, Chapter 255, as if the
2626 transfer on death deed were a devise made in a will; and
2727 (3) subject to Subdivision (2) [(4)], concurrent
2828 interests are transferred to the beneficiaries in equal and
2929 undivided shares with no right of survivorship[; and
3030 [(4) notwithstanding Subdivision (2), if the
3131 transferor has identified two or more designated beneficiaries to
3232 receive concurrent interests in the real property, the share of a
3333 designated beneficiary who predeceases the transferor lapses and is
3434 subject to and passes in accordance with Subchapter D, Chapter 255,
3535 as if the transfer on death deed were a devise made in a will].
3636 SECTION 2. Section 114.151, Estates Code, is amended to
3737 read as follows:
3838 Sec. 114.151. OPTIONAL FORM FOR TRANSFER ON DEATH DEED. The
3939 following form may be used to create a transfer on death deed.

4949 MUST RECORD DEED: Before your death, this deed must be recorded
5050 with the county clerk where the property is located, or it will not
5151 be effective.
5252 MARRIED PERSONS: If you are married and want your spouse to own the
5353 property on your death, you must name your spouse as the primary
5454 beneficiary. If your spouse does not survive you, the property
5555 will transfer to any listed alternate beneficiary or beneficiaries

176176 1. Owner (Transferor) Making this Deed: Enter your first, middle
177177 (if any), and last name here, along with your mailing address.
178178 2. Legal Description of the Property: Enter the formal legal
179179 description of the property. This information is different from
180180 the mailing and physical address for the property and is necessary
181181 to complete the form. To find this information, look on the deed
182182 you received when you became an owner of the property. This
183183 information may also be available in the office of the county clerk
184184 for the county where the property is located. Do NOT use your tax
185185 bill to find this information. If you are not absolutely sure,
186186 consult a lawyer.

189189 4. Primary Beneficiary or Beneficiaries: Enter the first and
190190 last name of each person you want to get the property when you die.

202202 enter the date until you are before a notary. Include your printed

204204 8. Acknowledgment: This deed must be signed before a notary. The
205205 notary will fill out this section of the deed.
206206 SECTION 3. The changes in law made by this Act apply to a
207207 transfer on death deed executed and acknowledged on or after the
208208 effective date of this Act. A transfer on death deed executed and
209209 acknowledged before the effective date of this Act is governed by
210210 the law in effect on the date the transfer on death deed was
211211 executed and acknowledged, and the former law is continued in
212212 effect for that purpose.
213213 SECTION 4. This Act takes effect September 1, 2017.
