66 AN ACT
77 relating to notice for patients of freestanding emergency medical
88 care facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 254, Health and Safety
1111 Code, is amended by adding Section 254.156 to read as follows:
1212 Sec. 254.156. PATIENT NOTICE. (a) A facility shall provide
1313 to a patient a notice that:
1414 (1) states whether the facility participates in a
1515 provider network, as described by Section 254.001, and lists each
1616 provider network in which the facility participates;
1717 (2) states whether the facility is an enrolled
1818 provider under Medicaid;
1919 (3) states:
2020 (A) whether the facility accepts Medicare
2121 assignment;
2222 (B) whether the facility accepts the payment
2323 terms of, or is a network provider under, any Medicare Advantage
2424 plan; and
2525 (C) each plan that provides this coverage for
2626 facility patients;
2727 (4) states whether the facility is a network provider
2828 under the TRICARE Military Health System or is a non-network
2929 provider accepting TRICARE patients;
3030 (5) provides the address, phone number, and hours of
3131 operation of the nearest facility that provides urgent care but
3232 that is not an emergency care facility or hospital emergency
3333 department; and
3434 (6) lists the Internet website, phone number, and
3535 e-mail address of the Texas Department of Insurance.
3636 (b) The notice must be:
3737 (1) provided on a single page not less than 8.5 inches
3838 by 11 inches in size; and
3939 (2) printed using a font that is at least 14 points in
4040 size.
4141 (c) The facility shall provide the notice to a patient as
4242 soon as possible after the patient enters the facility and before
4343 the patient receives a medical or health care service at the
4444 facility. The facility shall retain a copy of the notice, signed by
4545 the patient, in the patient's medical records. A patient who is
4646 incapacitated is not required to sign the notice. The facility
4747 shall provide the notice to a person who accompanies the
4848 incapacitated patient to the facility, if any.
4949 (d) A facility shall publish the notice on the facility's
5050 Internet website.
5151 SECTION 2. A freestanding medical care emergency facility
5252 is not required to comply with Section 254.156, Health and Safety
5353 Code, as added by this Act, before January 1, 2018.
5454 SECTION 3. This Act takes effect September 1, 2017.
