66 AN ACT
77 relating to a report concerning health care providers participating
88 in the breast and cervical cancer services program, the family
99 planning program, and the Texas women's health program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1212 amended by adding Section 531.02222 to read as follows:
1313 Sec. 531.02222. REPORT ON PROVIDERS PARTICIPATING IN
1414 WOMEN'S HEALTH PROGRAMS. (a) In this section:
1515 (1) "Breast and cervical cancer services program"
1616 means a program operated by the commission that provides screening,
1717 diagnostic, and other services related to breast and cervical
1818 cancer to women in this state.
1919 (2) "Family planning program" means a program operated
2020 by the commission that provides health care and core family
2121 planning services to individuals in this state.
2222 (3) "Texas women's health program" means a program
2323 operated by the commission that is substantially similar to the
2424 demonstration project operated under former Section 32.0248, Human
2525 Resources Code, and that is intended to expand access to preventive
2626 health and family planning services for women in this state.
2727 (b) Not later than December 31 of each even-numbered year,
2828 the commission shall prepare and submit a report to the legislature
2929 on the registered provider locations participating in the breast
3030 and cervical cancer services program, the family planning program,
3131 and the Texas women's health program. The report must:
3232 (1) cover the period beginning June 1 occurring three
3333 years preceding the year in which the report is due and ending May
3434 31 occurring the year before the year in which the report is due;
3535 and
3636 (2) include, for each registered provider location
3737 during the period covered by the report:
3838 (A) the number of physicians participating in
3939 each program at that location;
4040 (B) the number of individuals seen by each
4141 physician participating in a program at that location and the
4242 program in which the individuals were treated; and
4343 (C) the number of times a specific individual was
4444 treated at that location by a participating physician in each
4545 program.
4646 (c) If the breast and cervical cancer services program, the
4747 family planning program, or the Texas women's health program is
4848 consolidated with another program or otherwise modified, the
4949 commission shall include in the report under Subsection (b) the
5050 required information for each successor program that provides the
5151 same or similar services.
5252 (d) The information provided under Subsection (b) may not
5353 include any personally identifying information about an
5454 individual.
5555 SECTION 2. Not later than December 31, 2018, the Health and
5656 Human Services Commission shall provide to the legislature the
5757 initial report for the period of June 1, 2016, through May 31, 2017,
5858 as required by Section 531.02222, Government Code, as added by this
5959 Act, notwithstanding Section 531.02222(b)(1), Government Code, as
6060 added by this Act.
6161 SECTION 3. This Act takes effect September 1, 2017.
