55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the provision of municipal notices by utility bill and
88 mail.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 2051, Government Code, is
1111 amended by adding Section 2051.054 to read as follows:
1212 Sec. 2051.054. NOTICE OF MUNICIPALITY BY UTILITY BILL AND
1313 MAIL. (a) In this section, "utility" means a person that provides
1414 to the public gas, electricity, telephone, wastewater, or water
1515 service.
1616 (b) A municipality may satisfy a requirement in any other
1717 law to provide notice by publication in a newspaper by:
1818 (1) contracting with a utility to:
1919 (A) include a copy of the notice in the utility
2020 bill that is received by each utility customer; and
2121 (B) provide the municipality with a list of
2222 utility customers that includes the address of each customer; and
2323 (2) mailing the notice to municipal residents who do
2424 not receive a utility bill.
2525 (c) A municipality or utility providing notice under this
2626 section shall ensure that the notice is received at least one day
2727 before the date of the event for which the notice is provided.
2828 SECTION 2. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2017.
