|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 2051, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 2051.054 to read as follows: |
|---|
| 12 | 12 | | Sec. 2051.054. NOTICE OF MUNICIPALITY BY UTILITY BILL AND |
|---|
| 13 | 13 | | MAIL. (a) In this section, "utility" means a person that provides |
|---|
| 14 | 14 | | to the public gas, electricity, telephone, wastewater, or water |
|---|
| 15 | 15 | | service. |
|---|
| 16 | 16 | | (b) A municipality may satisfy a requirement in any other |
|---|
| 17 | 17 | | law to provide notice by publication in a newspaper by: |
|---|
| 18 | 18 | | (1) contracting with a utility to: |
|---|
| 19 | 19 | | (A) include a copy of the notice in the utility |
|---|
| 20 | 20 | | bill that is received by each utility customer; and |
|---|
| 21 | 21 | | (B) provide the municipality with a list of |
|---|
| 22 | 22 | | utility customers that includes the address of each customer; and |
|---|
| 23 | 23 | | (2) mailing the notice to municipal residents who do |
|---|
| 24 | 24 | | not receive a utility bill. |
|---|
| 25 | 25 | | (c) A municipality or utility providing notice under this |
|---|
| 26 | 26 | | section shall ensure that the notice is received at least one day |
|---|
| 27 | 27 | | before the date of the event for which the notice is provided. |
|---|
| 28 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2017. |
