| 10 | 10 | | higher education include a disciplinary notation on a student's |
|---|
| 11 | 11 | | transcript under certain circumstances. |
|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 13 | 13 | | SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
|---|
| 14 | 14 | | amended by adding Section 51.9364 to read as follows: |
|---|
| 15 | 15 | | Sec. 51.9364. CERTAIN DISCIPLINARY NOTATIONS REQUIRED ON |
|---|
| 16 | 16 | | STUDENT TRANSCRIPTS. (a) In this section, "postsecondary |
|---|
| 17 | 17 | | educational institution" means an institution of higher education |
|---|
| 18 | 18 | | or a private or independent institution of higher education, as |
|---|
| 19 | 19 | | those terms are defined by Section 61.003. |
|---|
| 20 | 20 | | (b) If a postsecondary educational institution suspends or |
|---|
| 21 | 21 | | expels a student from the institution for any reason, the |
|---|
| 22 | 22 | | institution shall include on the student's transcript a |
|---|
| 23 | 23 | | disciplinary notation stating that the student was suspended or |
|---|
| 24 | 24 | | expelled, as applicable, from the institution. |
|---|
| 25 | 25 | | (c) If a student withdraws from a postsecondary educational |
|---|
| 26 | 26 | | institution pending disciplinary charges that may result in the |
|---|
| 27 | 27 | | student's suspension or expulsion from the institution, the |
|---|
| 28 | 28 | | institution may not end the disciplinary process until the |
|---|
| 29 | 29 | | institution makes a final determination of responsibility, |
|---|
| 30 | 30 | | including, if applicable, a determination of whether to suspend or |
|---|
| 31 | 31 | | expel the student from the institution as a result. If the |
|---|
| 32 | 32 | | institution suspends or expels the student from the institution, |
|---|
| 33 | 33 | | the institution shall include a disciplinary notation on the |
|---|
| 34 | 34 | | student's transcript stating that the student was suspended or |
|---|
| 35 | 35 | | expelled, as applicable, from the institution. |
|---|
| 36 | 36 | | (d) On request by the student, a postsecondary educational |
|---|
| 37 | 37 | | institution may remove from a student's transcript a disciplinary |
|---|
| 38 | 38 | | notation indicating the student's suspension or expulsion, as |
|---|
| 39 | 39 | | applicable, from the institution if the institution determines |
|---|
| 40 | 40 | | that: |
|---|
| 41 | 41 | | (1) each condition of the suspension has been |
|---|
| 42 | 42 | | fulfilled, if applicable; or |
|---|
| 43 | 43 | | (2) good cause exists to remove the notation. |
|---|
| 44 | 44 | | (e) The Texas Higher Education Coordinating Board shall |
|---|
| 45 | 45 | | adopt rules as necessary to implement this section. |
|---|
| 46 | 46 | | SECTION 2. The Texas Higher Education Coordinating Board |
|---|
| 47 | 47 | | shall adopt the rules required by Section 51.9364, Education Code, |
|---|
| 48 | 48 | | as added by this Act, as soon as practicable after this Act takes |
|---|
| 49 | 49 | | effect. |
|---|
| 50 | 50 | | SECTION 3. The change in law made by this Act applies |
|---|
| 51 | 51 | | beginning with the 2017 fall semester. |
|---|
| 52 | 52 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 53 | 53 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 54 | 54 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 55 | 55 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 56 | 56 | | Act takes effect September 1, 2017. |
