66 AN ACT
77 relating to a pilot program for providing services to certain
88 children under the Medicaid medical transportation program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1111 amended by adding Section 531.024141 to read as follows:
1212 Sec. 531.024141. PILOT PROJECT FOR PROVIDING MEDICAL
1313 TRANSPORTATION PROGRAM SERVICES FOR CHILDREN ACCOMPANYING PREGNANT
1414 MOTHERS. (a) The commission shall develop and implement a pilot
1515 program to enable an eligible child described by Subsection (b) to
1616 receive medical transportation program services and to provide
1717 reimbursement for those services in order to:
1818 (1) increase access to prenatal and postpartum care;
1919 (2) reduce pregnancy-related complications;
2020 (3) improve health outcomes for pregnant women and
2121 infants; and
2222 (4) reduce the maternal mortality and morbidity rate.
2323 (b) A child is eligible for inclusion in the pilot program
2424 established under this section:
2525 (1) if the child's mother is:
2626 (A) a recipient of Medicaid during a pregnancy;
2727 and
2828 (B) is using medical transportation program
2929 services to travel to and from a covered health care service related
3030 to the pregnancy, including postpartum care; and
3131 (2) regardless of whether the child is also a
3232 recipient of Medicaid.
3333 (c) The pilot program shall be implemented in more than one
3434 health care service region.
3535 (d) The commission, with the assistance of the maternal
3636 mortality and morbidity task force established under Chapter 34,
3737 Health and Safety Code, shall evaluate the results of the pilot
3838 program and determine whether the program is effective in
3939 increasing access to prenatal and postpartum care, reducing
4040 pregnancy-related complications, improving health outcomes for
4141 pregnant women and their newborn children, and reducing the
4242 maternal mortality and morbidity rate. The evaluation must be
4343 based on:
4444 (1) the health outcomes of the pregnant women whose
4545 children participated in the program and of the women's newborn
4646 children; or
4747 (2) an assessment of the overall health care and
4848 pregnancy outcomes and trends in this state during the period of the
4949 program.
5050 (e) Not later than September 1, 2019, the commission shall
5151 report to the legislature on the results of the pilot program. The
5252 report must include:
5353 (1) a summary of the commission's evaluation under
5454 Subsection (d); and
5555 (2) the impact on costs under the medical
5656 transportation program.
5757 (f) The executive commissioner may adopt rules to implement
5858 this section.
5959 (g) This section expires September 1, 2019.
6060 SECTION 2. If before implementing any provision of this Act
6161 a state agency determines that a waiver or authorization from a
6262 federal agency is necessary for implementation of that provision,
6363 the agency affected by the provision shall request the waiver or
6464 authorization and may delay implementing that provision until the
6565 waiver or authorization is granted.
6666 SECTION 3. This Act takes effect September 1, 2017.
