97 relating to demonstration projects to coordinate eligibility
108 renewal and eligibility recertification for certain children in the
119 Medicaid and child health plan programs.
1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1311 SECTION 1. Subchapter C, Chapter 62, Health and Safety
1412 Code, is amended by adding Section 62.1025 to read as follows:
1513 Sec. 62.1025. ELIGIBILITY RENEWAL DEMONSTRATION PROJECT.
1614 (a) The commission shall establish a demonstration project through
1715 the child health plan program to allow the commission to
1816 simultaneously renew the eligibility of multiple children within
1917 the same household who are eligible for enrollment in the program.
2018 (b) The executive commissioner shall adopt rules necessary
2119 to determine the scope of and eligibility for participating in the
2220 demonstration project.
2321 (c) The commission shall, to the extent possible, operate
2422 the demonstration project under this section in conjunction with
2523 the demonstration project under Section 32.02614, Human Resources
2624 Code. The demonstration project may not increase the frequency
2725 with which:
2826 (1) the eligibility of children participating in the
2927 demonstration project would otherwise be renewed; or
3028 (2) those children's household incomes are reviewed
3129 under Section 62.102(b).
3230 (d) Not later than December 1, 2020, the commission shall
3331 submit a report to the legislature regarding the commission's
3432 progress in establishing and operating the demonstration project
3533 and recommendations on continuing or expanding the demonstration
3634 project.
3735 (e) This section expires September 1, 2021.
3836 SECTION 2. Subchapter B, Chapter 32, Human Resources Code,
3937 is amended by adding Section 32.02614 to read as follows:
4038 Sec. 32.02614. ELIGIBILITY RECERTIFICATION DEMONSTRATION
4139 PROJECT. (a) In this section, "child health plan program" has the
4240 meaning assigned by Section 531.001, Government Code.
4341 (b) The commission shall establish a demonstration project
4442 through the medical assistance program to allow the commission, to
4543 the greatest extent possible, to develop and test solutions to
4644 simultaneously:
4745 (1) recertify and renew, as applicable, the
4846 eligibility of multiple children within the same household who are
4947 eligible for medical assistance under this chapter or for the child
5048 health plan program, including the eligibility of siblings when a
5149 child within the household reaches the age of one; and
5250 (2) verify the household income of all persons
5351 described by Subdivision (1) in accordance with this section to
5452 determine eligibility.
5553 (c) The demonstration project must include participation by
5654 one or more households in each of the following categories:
5755 (1) a household with children who are eligible for
5856 medical assistance or the child health plan program, at least one of
5957 whom is younger than the age of one;
6058 (2) a household with children who are eligible for
6159 medical assistance or the child health plan program, at least some
6260 of whom are not siblings; and
6361 (3) a household with at least one child who is eligible
6462 for medical assistance and at least one child who is eligible for
6563 the child health plan program.
6664 (d) The commission shall simultaneously verify the
6765 household income of all children within the same household
6866 participating in the demonstration project not more frequently than
6967 twice during each 12-month period, with the first verification
7068 occurring before the sixth month following the earliest date that a
7169 child within the household was determined to be eligible for the
7270 medical assistance program, and the second verification occurring
7371 after that six-month period but before the annual recertification
7472 date.
7573 (e) The executive commissioner shall adopt rules necessary
7674 to determine the scope of and eligibility for participating in the
7775 demonstration project.
7876 (f) The commission may establish the demonstration project
7977 in one or more geographic areas and form partnerships with entities
8078 experienced in outreach, application assistance, and enrolling
8179 recipients in the medical assistance program, the child health plan
8280 program, and any other health benefits coverage.
8381 (g) The commission shall, to the extent possible, operate
8482 the demonstration project under this section in conjunction with
8583 the demonstration project under Section 62.1025, Health and Safety
8684 Code.
8785 (h) Not later than December 1, 2020, the commission shall
8886 submit a report to the legislature regarding the commission's
8987 progress in establishing and operating the demonstration project
9088 and recommendations on continuing or expanding the demonstration
9189 project.
9290 (i) This section expires September 1, 2021.
9391 SECTION 3. Not later than September 1, 2018, the Health and
9492 Human Services Commission shall implement the eligibility renewal
9593 and eligibility recertification demonstration projects required by
9694 Section 62.1025, Health and Safety Code, as added by this Act, and
9795 Section 32.02614, Human Resources Code, as added by this Act.
9896 SECTION 4. If before implementing any provision of this Act
9997 a state agency determines that a waiver or authorization from a
10098 federal agency is necessary for implementation of that provision,
10199 the agency affected by the provision shall request the waiver or
102100 authorization and may delay implementing that provision until the
103101 waiver or authorization is granted.
104102 SECTION 5. This Act takes effect immediately if it receives
105103 a vote of two-thirds of all the members elected to each house, as
106104 provided by Section 39, Article III, Texas Constitution. If this
107105 Act does not receive the vote necessary for immediate effect, this
108106 Act takes effect September 1, 2017.
