55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to creation, attachment, perfection, and enforcement of
88 certain liens in the slaughtering of livestock.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 148.026, Agriculture Code, is amended by
1111 amending Subsection (b) and adding Subsection (c) to read as
1212 follows:
1313 (b) Notwithstanding Chapter 9, Business & Commerce Code, or
1414 any other law, a [A] lien under this section is attached and
1515 perfected on delivery of the livestock to the purchaser without
1616 further action, including the filing of a financial statement. The
1717 lien continues as to the animal, its carcass, its products, and the
1818 proceeds of any sale without regard to possession by the party
1919 entitled to the lien.
2020 (c) A provision of this section that relates to the
2121 creation, attachment, perfection, or enforcement of a lien controls
2222 to the extent of a conflict with Chapter 9, Business & Commerce
2323 Code, or other applicable law.
2424 SECTION 2. The heading to Section 148.026, Agriculture
2525 Code, is amended to read as follows:
2626 Sec. 148.026. SELLER'S LIEN.
2727 SECTION 3. Section 148.027(a), Agriculture Code, is amended
2828 to read as follows:
2929 (a) If an animal, its carcass, or its products is under a
3030 lien under Section 148.026 and is commingled with other livestock,
3131 carcasses, or products so that the identity is lost, the lien
3232 extends to all of the commingled animals, carcasses, or products as
3333 if the lien had been perfected originally in all of them.
3434 SECTION 4. Section 148.028, Agriculture Code, is amended to
3535 read as follows:
3636 Sec. 148.028. PRIORITY OF SELLER'S LIEN. (a) Except as
3737 provided by Subsection (b), a [A] lien under Section 148.026 [this
3838 subchapter] has priority over any other lien or perfected security
3939 interest in the animal, its carcass, its products, or proceeds from
4040 the sale of the animal, its carcass, or its products.
4141 (b) A lien under Section 148.031 on an animal, its carcass,
4242 its products, or any proceeds from the disposition of the animal,
4343 its carcass, or its products has priority over a lien under Section
4444 148.026.
4545 SECTION 5. Subchapter C, Chapter 148, Agriculture Code, is
4646 amended by adding Section 148.031 to read as follows:
4747 Sec. 148.031. TERMINAL LIVESTOCK FEEDING FACILITY LIEN.
4848 (a) In this section, "terminal livestock feeding facility" means a
4949 facility that provides feeding and care to livestock that are left
5050 with the facility for preparation for slaughter.
5151 (b) To secure the payment of the charges for the services
5252 provided by a terminal livestock feeding facility, the facility has
5353 a lien on:
5454 (1) each animal left with the facility;
5555 (2) the products from each animal; and
5656 (3) all proceeds from the disposition of each animal,
5757 its carcass, or its products.
5858 (c) A lien under this section secures the amount of charges
5959 due under an agreement or, if an amount is not specified by
6060 agreement, the reasonable and usual compensation for services that
6161 are similar to the services provided by the terminal livestock
6262 feeding facility.
6363 (d) Notwithstanding Chapter 9, Business & Commerce Code, or
6464 any other law, a lien under this section attaches on the date on
6565 which a terminal livestock feeding facility first provides feed and
6666 care to an animal left with the facility and is perfected on
6767 attachment and remains perfected without further action by the
6868 facility, including the filing of a financial statement. Until the
6969 lien is satisfied, the lien continues as to the animal, its carcass,
7070 its products, and any proceeds from the disposition of the animal,
7171 its carcass, or its products regardless of whether the facility
7272 retains possession of the animal.
7373 (e) A lien under this section has priority over any other
7474 lien or perfected security interest in an animal, its carcass, its
7575 products, or any proceeds from the disposition of the animal, its
7676 carcass, or its products, regardless of whether the lien under this
7777 section was created or perfected after the date on which another
7878 lien was created or perfected.
7979 (f) A person who acquires an interest in an animal, its
8080 carcass, its products, or any proceeds from the disposition of the
8181 animal, its carcass, or its products subject to a lien under this
8282 section shall pay to the terminal livestock feeding facility the
8383 amount of the charges secured by the lien.
8484 (g) A terminal livestock feeding facility holding a lien
8585 under this section may enforce that lien in any manner authorized by
8686 Chapter 9, Business & Commerce Code, and may recover:
8787 (1) the reasonable costs of collection and
8888 enforcement; and
8989 (2) the reasonable attorney's fees and legal expenses
9090 incurred by the facility.
9191 (h) A provision of this section that relates to the
9292 creation, attachment, perfection, or enforcement of a lien controls
9393 to the extent of a conflict with Chapter 9, Business & Commerce
9494 Code, or other applicable law.
9595 SECTION 6. This Act takes effect September 1, 2017.
