66 AN ACT
77 relating to the duty of an excavator to notify a notification center
88 or to make a 9-1-1 emergency call in response to underground
99 facility damage or an emergency.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 251.152, Utilities Code, is amended to
1212 read as follows:
1313 Sec. 251.152. INFORMATION INCLUDED IN NOTICE. The
1414 excavator shall include in the notice required under Sections
1515 [Section] 251.151 and 251.155:
1616 (1) the name of the person serving the notice;
1717 (2) the location of the proposed area of excavation,
1818 including:
1919 (A) the street address, if available, and the
2020 location of the excavation at the street address; or
2121 (B) if there is no street address, an accurate
2222 description of the excavation area using any available designations
2323 such as the closest street, road, or intersection;
2424 (3) the name, address, and telephone number of the
2525 excavator or the excavator's company;
2626 (4) the excavator's field telephone number, if one is
2727 available;
2828 (5) for an excavation that is not an emergency, a
2929 telephone facsimile number, e-mail address, or another electronic
3030 number or address approved by the board to which an operator may
3131 send the notification required by Section 251.157(d);
3232 (6) the starting date and time and the anticipated
3333 completion date of excavation; [and]
3434 (7) a statement as to whether explosives will be used;
3535 and
3636 (8) for an emergency excavation, information about the
3737 conditions that create the emergency.
3838 SECTION 2. Sections 251.155(b) and (c), Utilities Code, are
3939 amended to read as follows:
4040 (b) If the emergency involves a flammable material, the
4141 [The] excavator:
4242 (1) may begin emergency excavation under Subsection
4343 (a) immediately, before notifying a notification center;
4444 (2) shall notify a notification center as promptly as
4545 practicably possible; and
4646 (3) shall take reasonable care to protect underground
4747 facilities.
4848 (c) If the emergency does not involve a flammable material,
4949 the excavator:
5050 (1) [When an emergency exists, the excavator] shall
5151 notify a notification center as promptly as practicably possible;
5252 (2) may begin emergency excavation only after
5353 notifying the notification center; and
5454 (3) shall take reasonable care to protect underground
5555 facilities.
5656 SECTION 3. Section 251.159, Utilities Code, is amended by
5757 amending Subsections (a) and (b) and adding Subsection (a-1) to
5858 read as follows:
5959 (a) If an excavation operation results in damage to an
6060 underground facility, including the defacing, scraping,
6161 displacement, penetration, destruction, or partial or complete
6262 severance or weakening of a protective coating, housing, or other
6363 protective device or structural or lateral support of a pipeline,
6464 the excavator shall immediately contact a notification center [the
6565 underground facility operator] to report the damage and, except as
6666 provided by Subsection (b), contact the underground facility
6767 operator.
6868 (a-1) If an excavation operation results in a release of
6969 materials transported by an underground facility, the excavator
7070 shall immediately make a 9-1-1 emergency call to report the
7171 release. Immediately after concluding the 9-1-1 emergency call,
7272 the excavator shall contact a notification center to report the
7373 release and, except as provided by Subsection (b), contact the
7474 underground facility operator.
7575 (b) If the excavator is not certain of the operator's
7676 identity, the excavator shall contact a notification center to
7777 report the damage, after complying with Subsection (a-1), if
7878 applicable, and the notification center shall immediately notify
7979 all other affected notification centers. Immediately on receiving
8080 notification, each notification center shall contact each member
8181 operator that has underground facilities in or near the area in
8282 which the damage occurred.
8383 SECTION 4. This Act takes effect September 1, 2017.
