10 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 12 | | SECTION 1. Subtitle G, Title 10, Government Code, is |
---|
12 | 13 | | amended by adding Chapter 2301 to read as follows: |
---|
13 | 14 | | CHAPTER 2301. ELECTRONIC ECONOMIC DEVELOPMENT INCENTIVES |
---|
14 | 15 | | INFORMATION AND APPLICATION SYSTEM |
---|
15 | 16 | | Sec. 2301.001. DEFINITIONS. In this chapter: |
---|
16 | 17 | | (1) "Department," "electronic government project," |
---|
17 | 18 | | and "state electronic Internet portal" have the meanings assigned |
---|
18 | 19 | | by Section 2054.003. |
---|
19 | 20 | | (2) "Monetary incentive" means a grant, loan, or other |
---|
20 | 21 | | form of monetary incentive paid from state revenues, including a |
---|
21 | 22 | | state trust fund, that a business entity or other person may receive |
---|
22 | 23 | | in exchange for or as a result of conducting an activity with an |
---|
23 | 24 | | economic development purpose. |
---|
24 | 25 | | (3) "State agency" means a department, commission, |
---|
25 | 26 | | board, office, council, authority, or other state agency in the |
---|
26 | 27 | | executive branch of state government. |
---|
27 | 28 | | (4) "Tax incentive" means any exemption, deduction, |
---|
28 | 29 | | credit, exclusion, waiver, rebate, discount, deferral, or other |
---|
29 | 30 | | abatement or reduction of state tax liability of a business entity |
---|
30 | 31 | | or other person that the person may receive in exchange for or as a |
---|
31 | 32 | | result of conducting an activity with an economic development |
---|
32 | 33 | | purpose. |
---|
33 | 34 | | Sec. 2301.002. ESTABLISHMENT OF PROJECT. The department |
---|
34 | 35 | | shall establish an electronic government project to develop an |
---|
35 | 36 | | Internet website accessible through the state electronic Internet |
---|
36 | 37 | | portal that: |
---|
37 | 38 | | (1) provides a single location that a business entity |
---|
38 | 39 | | considering relocating to or expanding in this state may use to |
---|
39 | 40 | | receive information relating to state monetary and tax incentives |
---|
40 | 41 | | for which the entity may be qualified; |
---|
41 | 42 | | (2) includes an interactive tool that allows a |
---|
42 | 43 | | business entity to determine whether the entity may be eligible for |
---|
43 | 44 | | any state monetary or tax incentive in this state; |
---|
44 | 45 | | (3) allows, when feasible, the business entity to fill |
---|
45 | 46 | | out one application for all: |
---|
46 | 47 | | (A) state monetary incentives for which the |
---|
47 | 48 | | entity may be eligible; and |
---|
48 | 49 | | (B) state tax incentives for which the entity may |
---|
49 | 50 | | be eligible, other than a tax incentive for which the entity, or a |
---|
50 | 51 | | transaction involving the entity, qualifies for by operation of |
---|
51 | 52 | | law; and |
---|
52 | 53 | | (4) allows, when feasible, for the application to be |
---|
53 | 54 | | submitted to each state agency that offers the monetary or tax |
---|
54 | 55 | | incentive described by Subdivision (3). |
---|
55 | 56 | | Sec. 2301.003. ESTABLISHING AND OPERATING PROJECT; |
---|
56 | 57 | | COORDINATION. In establishing and operating the electronic |
---|
57 | 58 | | government project under this chapter, the department, in |
---|
58 | 59 | | coordination with the Texas Economic Development and Tourism |
---|
59 | 60 | | Office, the Texas Workforce Commission, and the comptroller, shall |
---|
60 | 61 | | direct, coordinate, and assist state agencies in establishing and |
---|
61 | 62 | | using: |
---|
62 | 63 | | (1) a common electronic application and reporting |
---|
63 | 64 | | system, including: |
---|
64 | 65 | | (A) a standard format for announcing monetary and |
---|
65 | 66 | | tax incentive opportunities, including monetary and tax incentives |
---|
66 | 67 | | from: |
---|
67 | 68 | | (i) the Texas Enterprise Fund under Section |
---|
68 | 69 | | 481.078; |
---|
69 | 70 | | (ii) the moving image industry incentive |
---|
70 | 71 | | program under Subchapter B, Chapter 485; and |
---|
71 | 72 | | (iii) the skills development fund program |
---|
72 | 73 | | under Chapter 303, Labor Code; |
---|
73 | 74 | | (B) standard data elements for use in creating |
---|
74 | 75 | | monetary and tax incentive opportunity announcement summaries, |
---|
75 | 76 | | including existing monetary and tax incentives and search |
---|
76 | 77 | | functions; and |
---|
77 | 78 | | (C) a common application form for a person to use |
---|
78 | 79 | | in applying for the following from multiple state agencies: |
---|
79 | 80 | | (i) all state monetary incentives for which |
---|
80 | 81 | | the entity may be eligible; and |
---|
81 | 82 | | (ii) all state tax incentives for which the |
---|
82 | 83 | | entity may be eligible, other than a tax incentive for which the |
---|
83 | 84 | | entity, or a transaction involving the entity, qualifies for by |
---|
84 | 85 | | operation of law; and |
---|
85 | 86 | | (2) a process for: |
---|
86 | 87 | | (A) improving interagency coordination of |
---|
87 | 88 | | information collection and sharing of data relating to monetary and |
---|
88 | 89 | | tax incentives; and |
---|
89 | 90 | | (B) improving the timeliness, completeness, and |
---|
90 | 91 | | quality of applications received by a state agency for monetary and |
---|
91 | 92 | | tax incentives described by Subdivision (1). |
---|
92 | 93 | | SECTION 2. Section 303.005(a), Labor Code, is amended to |
---|
93 | 94 | | read as follows: |
---|
94 | 95 | | (a) An employer may not apply both to a public community or |
---|
95 | 96 | | technical college for customized training and assessment from the |
---|
96 | 97 | | college through a grant issued to the college under the skills |
---|
97 | 98 | | development fund program established under this chapter and for a |
---|
98 | 99 | | grant under the Texas Enterprise Fund program established under |
---|
99 | 100 | | Subchapter E, Chapter 481, Government Code, unless the employer and |
---|
100 | 101 | | the college file an application for concurrent participation in |
---|
101 | 102 | | both programs using a common electronic application under Section |
---|
102 | 103 | | 2301.003, Government Code [that complies with any rules adopted by |
---|
103 | 104 | | the Texas Workforce Commission on concurrent participation]. |
---|
104 | 105 | | SECTION 3. This Act takes effect September 1, 2017. |
