55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to an environmental report as part of a municipality's
88 comprehensive plan for long-range development.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 213.003, Local Government Code, is
1111 amended by amending Subsection (a) and adding Subsection (c) to
1212 read as follows:
1313 (a) A comprehensive plan may be adopted or amended only by
1414 ordinance following:
1515 (1) a hearing at which the public is given the
1616 opportunity to give testimony and present written evidence; and
1717 (2) review by the municipality's planning commission
1818 or department, if one exists.
1919 (c) The governing body of a municipality that has adopted a
2020 comprehensive plan shall update the plan at least every five years.
2121 SECTION 2. Chapter 213, Local Government Code, is amended
2222 by adding Section 213.006 to read as follows:
2323 Sec. 213.006. ENVIRONMENTAL EVALUATION REPORT. (a) As
2424 part of a municipality's comprehensive plan, the municipality's
2525 governing body must also adopt an environmental evaluation report
2626 that includes:
2727 (1) projected environmental changes that may be
2828 reasonably anticipated due to implementation of the comprehensive
2929 plan regarding air, water, and soil quality;
3030 (2) any adverse environmental effects to be monitored
3131 due to changes in air, water, and soil quality;
3232 (3) an evaluation of projected environmental benefits
3333 that may be reasonably related to implementation of the
3434 comprehensive plan;
3535 (4) an evaluation of adverse environmental results
3636 that may be reasonably related to implementation of the
3737 comprehensive plan;
3838 (5) measures for the identification and environmental
3939 protection of environmental resources that may reasonably be
4040 affected by the plan; and
4141 (6) either:
4242 (A) an assessment of the cost to remedy or
4343 mitigate any adverse effects or results identified in Subdivisions
4444 (2) and (4); or
4545 (B) a feasibility study of alternative planning
4646 that mitigates those adverse effects or results.
4747 (b) The environmental evaluation report may include:
4848 (1) the organizational structure of community
4949 planning committees; and
5050 (2) the identification of best practices, procedures,
5151 processes, and resources for developing, implementing, achieving,
5252 reviewing, and maintaining continuous improvement in environmental
5353 policy.
5454 SECTION 3. This Act takes effect September 1, 2017.
