6	6	AN ACT
7	7	relating to an exemption from payment of tolls for certain
8	8	vehicles.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 228.054(a), Transportation Code, is
11	11	amended to read as follows:
12	12	(a) Except as provided by Subsection (e) or Section
13	13	228.0545, the operator of a vehicle, other than an authorized
14	14	emergency vehicle or a vehicle exempt from payment of registration
15	15	fees under Subchapter J, Chapter 502 [, as defined by Section
16	16	541.201], that is driven or towed through a toll collection
17	17	facility shall pay the proper toll. The exemption from payment of a
18	18	toll for an authorized emergency vehicle applies regardless of
19	19	whether the vehicle is:
20	20	(1) responding to an emergency;
21	21	(2) displaying a flashing light; or
22	22	(3) marked as an emergency vehicle.
23	23	SECTION 2. Section 284.070, Transportation Code, is amended
24	24	by adding Subsection (f) to read as follows:
25	25	(f) A vehicle exempt from payment of registration fees under
26	26	Subchapter J, Chapter 502, is exempt from payment of a toll imposed
27	27	under this chapter.
28	28	SECTION 3. Section 366.178, Transportation Code, is amended
29	29	by amending Subsection (a) and adding Subsection (a-1) to read as
30	30	follows:
31	31	(a) A motor vehicle, other than an authorized emergency
32	32	vehicle or a vehicle exempt from payment of registration fees under
33	33	Subchapter J, Chapter 502 [, as defined by Section 541.201], that
34	34	passes through a toll assessment facility, whether driven or towed,
35	35	shall pay the proper toll. The exemption from payment of a toll for
36	36	an authorized emergency vehicle applies regardless of whether the
37	37	vehicle is:
38	38	(1) responding to an emergency;
39	39	(2) displaying a flashing light; or
40	40	(3) marked as a police or emergency vehicle.
41	41	(a-1) In this section, "authorized emergency vehicle" has
42	42	the meaning assigned by Section 541.201.
43	43	SECTION 4. Sections 370.177(a) and (k), Transportation
44	44	Code, are amended to read as follows:
45	45	(a) Except as provided by Subsection (a-1), the operator of
46	46	a vehicle, other than an authorized emergency vehicle or a vehicle
47	47	that is exempt from payment of registration fees under Subchapter
48	48	J, Chapter 502 [as defined by Section 541.201], that is driven or
49	49	towed through a toll collection facility of a turnpike project
50	50	shall pay the proper toll. The operator of a vehicle who drives or
51	51	tows a vehicle through a toll collection facility and does not pay
52	52	the proper toll commits an offense. An offense under this
53	53	subsection is a misdemeanor punishable by a fine not to exceed $250.
54	54	The exemption from payment of a toll for an authorized emergency
55	55	vehicle applies regardless of whether the vehicle is:
56	56	(1) responding to an emergency;
57	57	(2) displaying a flashing light; or
58	58	(3) marked as an emergency vehicle.
59	59	(k) In this section:
60	60	(1) "Authorized emergency vehicle" has the meaning
61	61	assigned by Section 541.201.
62	62	(2) "Registered [, "registered] owner" means the owner
63	63	of a vehicle as shown on the vehicle registration records of the
64	64	department or the analogous department or agency of another state
65	65	or country.
66	66	SECTION 5. The change in law made by this Act applies only
67	67	to the collection of a toll incurred on or after the effective date
68	68	of this Act. The collection of a toll incurred before the effective
69	69	date of this Act is governed by the law in effect immediately before
70	70	the effective date of this Act, and that law is continued in effect
71	71	for that purpose.
72	72	SECTION 6. This Act takes effect September 1, 2017.
