66 AN ACT
77 relating to an exemption from payment of tolls for certain
88 vehicles.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 228.054(a), Transportation Code, is
1111 amended to read as follows:
1212 (a) Except as provided by Subsection (e) or Section
1313 228.0545, the operator of a vehicle, other than an authorized
1414 emergency vehicle or a vehicle exempt from payment of registration
1515 fees under Subchapter J, Chapter 502 [, as defined by Section
1616 541.201], that is driven or towed through a toll collection
1717 facility shall pay the proper toll. The exemption from payment of a
1818 toll for an authorized emergency vehicle applies regardless of
1919 whether the vehicle is:
2020 (1) responding to an emergency;
2121 (2) displaying a flashing light; or
2222 (3) marked as an emergency vehicle.
2323 SECTION 2. Section 284.070, Transportation Code, is amended
2424 by adding Subsection (f) to read as follows:
2525 (f) A vehicle exempt from payment of registration fees under
2626 Subchapter J, Chapter 502, is exempt from payment of a toll imposed
2727 under this chapter.
2828 SECTION 3. Section 366.178, Transportation Code, is amended
2929 by amending Subsection (a) and adding Subsection (a-1) to read as
3030 follows:
3131 (a) A motor vehicle, other than an authorized emergency
3232 vehicle or a vehicle exempt from payment of registration fees under
3333 Subchapter J, Chapter 502 [, as defined by Section 541.201], that
3434 passes through a toll assessment facility, whether driven or towed,
3535 shall pay the proper toll. The exemption from payment of a toll for
3636 an authorized emergency vehicle applies regardless of whether the
3737 vehicle is:
3838 (1) responding to an emergency;
3939 (2) displaying a flashing light; or
4040 (3) marked as a police or emergency vehicle.
4141 (a-1) In this section, "authorized emergency vehicle" has
4242 the meaning assigned by Section 541.201.
4343 SECTION 4. Sections 370.177(a) and (k), Transportation
4444 Code, are amended to read as follows:
4545 (a) Except as provided by Subsection (a-1), the operator of
4646 a vehicle, other than an authorized emergency vehicle or a vehicle
4747 that is exempt from payment of registration fees under Subchapter
4848 J, Chapter 502 [as defined by Section 541.201], that is driven or
4949 towed through a toll collection facility of a turnpike project
5050 shall pay the proper toll. The operator of a vehicle who drives or
5151 tows a vehicle through a toll collection facility and does not pay
5252 the proper toll commits an offense. An offense under this
5353 subsection is a misdemeanor punishable by a fine not to exceed $250.
5454 The exemption from payment of a toll for an authorized emergency
5555 vehicle applies regardless of whether the vehicle is:
5656 (1) responding to an emergency;
5757 (2) displaying a flashing light; or
5858 (3) marked as an emergency vehicle.
5959 (k) In this section:
6060 (1) "Authorized emergency vehicle" has the meaning
6161 assigned by Section 541.201.
6262 (2) "Registered [, "registered] owner" means the owner
6363 of a vehicle as shown on the vehicle registration records of the
6464 department or the analogous department or agency of another state
6565 or country.
6666 SECTION 5. The change in law made by this Act applies only
6767 to the collection of a toll incurred on or after the effective date
6868 of this Act. The collection of a toll incurred before the effective
6969 date of this Act is governed by the law in effect immediately before
7070 the effective date of this Act, and that law is continued in effect
7171 for that purpose.
7272 SECTION 6. This Act takes effect September 1, 2017.
