44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to certain emergency medical services.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 773.003, Health and Safety Code, is
99 amended by adding Subdivision (18-a) to read as follows:
1010 (18-a) "Patient" means a person who:
1111 (A) has a perceived need for medical care or
1212 transportation for a physiological or psychological illness or
1313 injury;
1414 (B) requires medical observation, monitoring, or
1515 assessment; and
1616 (C) is either awaiting treatment or already under
1717 treatment for the related condition.
1818 SECTION 2. Sections 773.014(a), (b), (c), (c-1), (d), (e),
1919 (f), and (g), Health and Safety Code, are amended to read as
2020 follows:
2121 (a) An emergency medical services provider and a first
2222 responder organization may acquire and possess epinephrine
2323 [auto-injector devices] in accordance with this section. Emergency
2424 medical services personnel may carry and administer epinephrine
2525 [auto-injector devices] in accordance with this section.
2626 (b) The executive commissioner shall adopt rules designed
2727 to protect the public health and safety to implement this section.
2828 The rules must provide that emergency medical services personnel
2929 may administer [an] epinephrine [auto-injector device] to another
3030 only if the person has successfully completed a training course,
3131 approved by the department, in the methods of administering
3232 epinephrine [use of the device] that is consistent with the
3333 national standard training curriculum for emergency medical
3434 technicians.
3535 (c) An emergency medical services provider or first
3636 responder organization may acquire, possess, maintain, and dispose
3737 of epinephrine [auto-injector devices], and emergency medical
3838 services personnel may carry, maintain, administer, and dispose of
3939 epinephrine [auto-injector devices], only in accordance with:
4040 (1) rules adopted under this section; and
4141 (2) a delegated practice agreement that provides for
4242 medical supervision by a licensed physician who either:
4343 (A) acts as a medical director for an emergency
4444 medical services system or a licensed hospital; or
4545 (B) has knowledge and experience in the delivery
4646 of emergency care.
4747 (c-1) A licensed physician acting as a medical director for
4848 an emergency medical services system may restrict the [use and]
4949 administration of epinephrine [auto-injector devices] to certain
5050 emergency medical services personnel of the system through:
5151 (1) the delegated practice agreement; or
5252 (2) the adoption of policies governing the
5353 administration [use] of epinephrine [the devices] by personnel
5454 within the system.
5555 (d) Emergency medical services personnel who administer
5656 epinephrine [auto-injector devices] to others shall [immediately]
5757 report the administration of epinephrine [use] to the physician
5858 supervising the activities of the emergency medical services
5959 personnel in accordance with approved treatment protocols.
6060 (e) The administration of [an] epinephrine [auto-injector
6161 device] to another under this section is considered to be the
6262 administration of emergency care for the purposes of any statute
6363 relating to liability for the provision of emergency care. The
6464 administration of [an] epinephrine [auto-injector device] to
6565 another in accordance with the requirements of this section does
6666 not constitute the unlawful practice of any health care profession.
6767 (f) A person otherwise authorized to sell or provide [an]
6868 epinephrine [auto-injector device] to another may sell or provide
6969 epinephrine [the devices] to an emergency medical services provider
7070 or a first responder organization authorized to acquire and possess
7171 epinephrine [the devices] under this section.
7272 (g) This section does not prevent emergency medical
7373 services personnel who are also licensed health care professionals
7474 under another health care licensing law and who are authorized to
7575 acquire, possess, and administer [an] epinephrine [auto-injector
7676 device] under the other health care licensing law from acting under
7777 the other law.
7878 SECTION 3. Section 773.050(g), Health and Safety Code, is
7979 amended to read as follows:
8080 (g) Rules adopting minimum standards under this section
8181 shall require:
8282 (1) an emergency medical services vehicle to carry a
8383 supply of [be equipped with an] epinephrine for the treatment of
8484 [auto-injector device or similar device to treat] anaphylaxis, when
8585 authorized by the emergency medical services provider's
8686 medical
8787 director; and
8888 (2) emergency medical services personnel to complete
8989 continuing education training in the administration of epinephrine
9090 as a treatment for anaphylaxis [treatment].
9191 SECTION 4. This Act takes effect September 1, 2017.
