55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the campus sexual assault policy at a public
88 institution of higher education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 51.9363, Education Code, is amended by
1111 amending Subsection (e) and adding Subsections (f), (g), and (h) to
1212 read as follows:
1313 (e) Each institution of higher education shall provide to
1414 students enrolled at the institution information regarding the
1515 protocol for reporting incidents of campus sexual assault adopted
1616 under Subsection (b), including the name, office location, and
1717 contact information of the institution's Title IX coordinator, by:
1818 (1) e-mailing the information to each student at the
1919 beginning of each semester or other academic term; and
2020 (2) including the information in the orientation
2121 required under Subsection (d).
2222 (f) As part of the protocol for responding to reports of
2323 campus sexual assault adopted under Subsection (b), each
2424 institution of higher education shall:
2525 (1) ensure that each alleged victim or alleged
2626 perpetrator of an incident of campus sexual assault and any other
2727 person who reports such an incident is offered counseling provided
2828 by a counselor who does not provide counseling to any other person
2929 involved in the incident; and
3030 (2) notwithstanding any other law, allow an alleged
3131 victim or alleged perpetrator of an incident of campus sexual
3232 assault to drop a course in which both parties are enrolled without
3333 any academic penalty.
3434 (g) An institution of higher education may not take any
3535 disciplinary action against a student enrolled at the institution
3636 who reports to the institution being the victim of, or a witness to,
3737 an incident of campus sexual assault for a violation by the student
3838 of the institution's policies on student conduct that involves
3939 alcohol or drug use and occurs in relation to the incident. This
4040 subsection may not be construed to limit an institution's ability
4141 to provide amnesty from application of the institution's policies
4242 in circumstances not described by this subsection.
4343 (h) Each biennium, each institution of higher education
4444 shall review the institution's campus sexual assault policy and,
4545 with approval of the institution's governing board, revise the
4646 policy as necessary.
4747 SECTION 2. Section 51.9363, Education Code, as amended by
4848 this Act, applies beginning with the 2017-2018 academic year.
4949 SECTION 3. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect September 1, 2017.
