44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to weight limitations for certain vehicles carrying
77 livestock.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 621.508, Transportation Code, is amended
1010 by amending subsection (a) and adding subsection (c) to read as
1111 follows:
1212 (a) It is an affirmative defense to prosecution of, or an
1313 action under Subchapter F for, the offense of operating a vehicle
1414 with a single axle weight or tandem axle weight heavier than the
1515 axle weight authorized by law that at the time of the offense the
1616 vehicle:
1717 (1) had a single axle weight or tandem axle weight that
1818 was not heavier than the axle weight authorized by law plus 12
1919 percent;
2020 (2) was loaded with timber, pulp wood, wood chips, or
2121 cotton, [livestock, ] or other agricultural products that are:
2222 (A) in their natural state; and
2323 (B) being transported from the place of
2424 production to the place of first marketing or first processing; and
2525 (3) was not being operated on a portion of the national
2626 system of interstate and defense highways.
2727 (c) It is an affirmative defense to prosecution of, or an
2828 action under Subchapter F for, the offense of operating a vehicle
2929 with a single axle weight or tandem axle weight heavier than the
3030 axle weight authorized by law that at the time of the offense the
3131 vehicle:
3232 (1) was loaded with livestock products that are:
3333 (A) in their natural state; and
3434 (B) being transported from the place of
3535 production to the place of first marketing or first processing; and
3636 (2) was not being operated on a portion of the national
3737 system of interstate and defense highways.
3838 SECTION 2. This Act takes effect September 1, 2017.
