| 6 | 6 | | relating to a requirement that each public institution of higher |

| 7 | 7 | | education develop and implement a strategic plan for the prevention |
|---|
| 8 | 8 | | of sexual assault and unplanned pregnancy. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 51.9364 to read as follows: |
|---|
| 12 | 12 | | Sec. 51.9364. STRATEGIC PLAN FOR PREVENTION OF SEXUAL |
|---|
| 13 | 13 | | ASSAULT AND UNPLANNED PREGNANCY. (a) In this section, |
|---|
| 14 | 14 | | "institution of higher education" has the meaning assigned by |
|---|
| 15 | 15 | | Section 61.003. |
|---|
| 16 | 16 | | (b) Each institution of higher education shall develop and |
|---|
| 17 | 17 | | implement a strategic plan for the prevention of sexual assault on |
|---|
| 18 | 18 | | the institution's campus and unplanned pregnancy among the students |
|---|
| 19 | 19 | | enrolled at the institution. |
|---|
| 20 | 20 | | (c) The strategic plan must: |
|---|
| 21 | 21 | | (1) identify opportunities for raising awareness |
|---|
| 22 | 22 | | among, and providing information and resources to, students |
|---|
| 23 | 23 | | regarding campus sexual assault and unplanned pregnancy |
|---|
| 24 | 24 | | prevention, including through: |
|---|
| 25 | 25 | | (A) the use of special events, presentations, and |
|---|
| 26 | 26 | | training sessions for students and student organizations; and |
|---|
| 27 | 27 | | (B) the integration of educational information |
|---|
| 28 | 28 | | into student orientation programs provided to new students and |
|---|
| 29 | 29 | | counseling or advising services provided to continuing students; |
|---|
| 30 | 30 | | and |
|---|
| 31 | 31 | | (2) be approved by the institution's governing board |
|---|
| 32 | 32 | | before final adoption by the institution. |
|---|
| 33 | 33 | | (d) Each biennium, each institution of higher education |
|---|
| 34 | 34 | | shall review the institution's strategic plan and, with approval of |
|---|
| 35 | 35 | | the institution's governing board, revise the plan as necessary. |
|---|
| 36 | 36 | | (e) In consultation with institutions of higher education, |
|---|
| 37 | 37 | | the Texas Higher Education Coordinating Board shall adopt any rules |
|---|
| 38 | 38 | | the coordinating board considers appropriate for the |
|---|
| 39 | 39 | | administration of this section. |
|---|
| 40 | 40 | | SECTION 2. Not later than January 1, 2018, the Texas Higher |
|---|
| 41 | 41 | | Education Coordinating Board shall adopt the rules required by |
|---|
| 42 | 42 | | Section 51.9364, Education Code, as added by this Act. |
|---|
| 43 | 43 | | SECTION 3. Not later than September 1, 2018, each public |
|---|
| 44 | 44 | | institution of higher education shall develop and implement the |
|---|
| 45 | 45 | | strategic plan required by Section 51.9364, Education Code, as |
|---|
| 46 | 46 | | added by this Act. |
|---|
| 47 | 47 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 48 | 48 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 49 | 49 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 50 | 50 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 51 | 51 | | Act takes effect September 1, 2017. |
