| 12 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 11 | | SECTION 1. Subchapter C, Chapter 39, Education Code, is |
|---|
| 14 | 12 | | amended by adding Section 39.0551 to read as follows: |

| 15 | 13 | | Sec. 39.0551. CERTAIN STUDENTS PARTICIPATING IN REGIONAL |
|---|
| 16 | 14 | | DAY SCHOOL PROGRAMS FOR THE DEAF NOT CONSIDERED FOR ACCOUNTABILITY |

| 17 | 15 | | PURPOSES. Notwithstanding any other provision of this code, in |
|---|
| 18 | 16 | | determining the performance of a school district or campus under |
|---|
| 19 | 17 | | this chapter, a student participating in a regional day school |
|---|
| 20 | 18 | | program for the deaf under Subchapter D, Chapter 30, whose parent or |
|---|
| 21 | 19 | | person standing in parental relation to the student does not reside |
|---|
| 22 | 20 | | in the school district providing program services is not considered |
|---|
| 23 | 21 | | a student of the district or campus in which the program is |
|---|
| 24 | 22 | | physically located. |
|---|
| 25 | 23 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 26 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 27 | | Act takes effect September 1, 2017. |
