44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the disposition of fines collected by a county or
77 municipality from the enforcement of commercial motor vehicle
88 safety standards.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 644.102(d) and (e), Transportation
1111 Code, are amended to read as follows:
1212 (d) In each fiscal year, a municipality may retain fines
1313 from the enforcement of this chapter in an amount not to exceed 50
1414 [110] percent of the municipality's actual expenses for enforcement
1515 of this chapter in the preceding fiscal year, as determined by the
1616 comptroller after reviewing the most recent municipal audit
1717 conducted under Section 103.001, Local Government Code. If there
1818 are no actual expenses for enforcement of this chapter in the most
1919 recent municipal audit, a municipality may retain fines in an
2020 amount not to exceed 50 [110] percent of the amount the comptroller
2121 estimates would be the municipality's actual expenses for
2222 enforcement of this chapter during the year.
2323 (e) In each fiscal year, a county may retain fines from the
2424 enforcement of this chapter in an amount not to exceed 50 [110]
2525 percent of the county's actual expenses for enforcement of this
2626 chapter in the preceding fiscal year, as determined by the
2727 comptroller after reviewing the most recent county audit conducted
2828 under Chapter 115, Local Government Code. If there are no actual
2929 expenses for enforcement of this chapter in the most recent county
3030 audit, a county may retain fines in an amount not to exceed 50 [110]
3131 percent of the amount the comptroller estimates would be the
3232 county's actual expenses for enforcement of this chapter during the
3333 year.
3434 SECTION 2. The change in law made by this Act applies only
3535 to a fiscal year beginning on or after the effective date of this
3636 Act.
3737 SECTION 3. This Act takes effect September 1, 2017.
