55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the service plan for the annexation by certain
88 municipalities of territory included in an emergency services
99 district.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 43.056(p), Local Government Code, is
1212 amended to read as follows:
1313 (p) This subsection applies only to a municipality in a
1414 county with a population of more than one million and less than 1.75
1515 [1.5] million. For a municipality that has adopted Chapter 143 and
1616 directly employs firefighters, a service plan that includes the
1717 provision of services to an area that, at the time the service plan
1818 is adopted, is located in the territory of an emergency services
1919 district:
2020 (1) must require the municipality's fire department to
2121 provide initial response to the annexed territory that is
2222 equivalent to that provided to other areas within the corporate
2323 boundaries of the municipality with similar topography, land use,
2424 and population density;
2525 (2) may not provide for municipal fire services to the
2626 annexed area solely or primarily by means of an automatic aid or
2727 mutual aid agreement with the affected emergency services district
2828 or other third-party provider of services; and
2929 (3) may authorize the emergency services district to
3030 provide supplemental fire and emergency medical services to the
3131 annexed area by means of an automatic aid or mutual aid agreement.
3232 SECTION 2. The change in law made by this Act to Section
3333 43.056(p), Local Government Code, applies only to the annexation of
3434 an area for which all parts of the statutory annexation process are
3535 begun on or after the effective date of this Act. The annexation of
3636 an area for which any part of the statutory annexation process was
3737 begun before the effective date of this Act is governed by the law
3838 in effect immediately before the effective date of this Act, and the
3939 former law is continued in effect for that purpose.
4040 SECTION 3. This Act takes effect September 1, 2017.
