| 7 | 7 | | relating to the service plan for the annexation by certain |

| 8 | 8 | | municipalities of territory included in an emergency services |
|---|
| 9 | 9 | | district. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 43.056(p), Local Government Code, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | (p) This subsection applies only to a municipality in a |
|---|
| 14 | 14 | | county with a population of more than one million and less than 1.75 |
|---|
| 15 | 15 | | [1.5] million. For a municipality that has adopted Chapter 143 and |
|---|
| 16 | 16 | | directly employs firefighters, a service plan that includes the |
|---|
| 17 | 17 | | provision of services to an area that, at the time the service plan |
|---|
| 18 | 18 | | is adopted, is located in the territory of an emergency services |
|---|
| 19 | 19 | | district: |
|---|
| 20 | 20 | | (1) must require the municipality's fire department to |
|---|
| 21 | 21 | | provide initial response to the annexed territory that is |
|---|
| 22 | 22 | | equivalent to that provided to other areas within the corporate |
|---|
| 23 | 23 | | boundaries of the municipality with similar topography, land use, |
|---|
| 24 | 24 | | and population density; |
|---|
| 25 | 25 | | (2) may not provide for municipal fire services to the |
|---|
| 26 | 26 | | annexed area solely or primarily by means of an automatic aid or |
|---|
| 27 | 27 | | mutual aid agreement with the affected emergency services district |
|---|
| 28 | 28 | | or other third-party provider of services; and |
|---|
| 29 | 29 | | (3) may authorize the emergency services district to |
|---|
| 30 | 30 | | provide supplemental fire and emergency medical services to the |
|---|
| 31 | 31 | | annexed area by means of an automatic aid or mutual aid agreement. |
|---|
| 32 | 32 | | SECTION 2. The change in law made by this Act to Section |
|---|
| 33 | 33 | | 43.056(p), Local Government Code, applies only to the annexation of |
|---|
| 34 | 34 | | an area for which all parts of the statutory annexation process are |
|---|
| 35 | 35 | | begun on or after the effective date of this Act. The annexation of |
|---|
| 36 | 36 | | an area for which any part of the statutory annexation process was |
|---|
| 37 | 37 | | begun before the effective date of this Act is governed by the law |
|---|
| 38 | 38 | | in effect immediately before the effective date of this Act, and the |
|---|
| 39 | 39 | | former law is continued in effect for that purpose. |

| 40 | 40 | | SECTION 3. This Act takes effect September 1, 2017. |
