| 7 | 7 | | relating to a student's eligibility to enroll in courses provided |

| 8 | 8 | | through the state virtual school network. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 30A.002(a) and (c), Education Code, are |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) A student is eligible to enroll in one or more courses [a |
|---|
| 13 | 13 | | course] provided through the state virtual school network or, |
|---|
| 14 | 14 | | except as provided by Section 30A.107(c), enroll full-time in |
|---|
| 15 | 15 | | courses provided through the network only if the student: |
|---|
| 16 | 16 | | (1) on September 1 of the school year: |
|---|
| 17 | 17 | | (A) is younger than 21 years of age; or |
|---|
| 18 | 18 | | (B) is younger than 26 years of age and entitled |
|---|
| 19 | 19 | | to the benefits of the Foundation School Program under Section |
|---|
| 20 | 20 | | 42.003; |
|---|
| 21 | 21 | | (2) has not graduated from high school; and |
|---|
| 22 | 22 | | (3) is otherwise eligible to enroll in a public school |
|---|
| 23 | 23 | | in this state. |
|---|
| 24 | 24 | | (c) Notwithstanding Subsection (a)(3) [or (b)], a student |
|---|
| 25 | 25 | | is eligible to enroll in one or more courses provided through the |
|---|
| 26 | 26 | | state virtual school network or, except as provided by Section |
|---|
| 27 | 27 | | 30A.107(c), enroll full-time in courses provided through the |
|---|
| 28 | 28 | | network if the student: |
|---|
| 29 | 29 | | (1) is a dependent of a member of the United States |
|---|
| 30 | 30 | | military; |
|---|
| 31 | 31 | | [(2) was previously enrolled in high school in this |
|---|
| 32 | 32 | | state;] and |
|---|
| 33 | 33 | | (2) [(3)] does not reside in this state due to a |
|---|
| 34 | 34 | | military deployment or transfer. |
|---|
| 35 | 35 | | SECTION 2. Section 30A.002(b), Education Code, is repealed. |
|---|
| 36 | 36 | | SECTION 3. This Act applies beginning with the 2017-2018 |
|---|
| 37 | 37 | | school year. |
|---|
| 38 | 38 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 39 | 39 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 40 | 40 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 41 | 41 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 42 | 42 | | Act takes effect September 1, 2017. |
