55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a student's eligibility to enroll in courses provided
88 through the state virtual school network.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 30A.002(a) and (c), Education Code, are
1111 amended to read as follows:
1212 (a) A student is eligible to enroll in one or more courses [a
1313 course] provided through the state virtual school network or,
1414 except as provided by Section 30A.107(c), enroll full-time in
1515 courses provided through the network only if the student:
1616 (1) on September 1 of the school year:
1717 (A) is younger than 21 years of age; or
1818 (B) is younger than 26 years of age and entitled
1919 to the benefits of the Foundation School Program under Section
2020 42.003;
2121 (2) has not graduated from high school; and
2222 (3) is otherwise eligible to enroll in a public school
2323 in this state.
2424 (c) Notwithstanding Subsection (a)(3) [or (b)], a student
2525 is eligible to enroll in one or more courses provided through the
2626 state virtual school network or, except as provided by Section
2727 30A.107(c), enroll full-time in courses provided through the
2828 network if the student:
2929 (1) is a dependent of a member of the United States
3030 military;
3131 [(2) was previously enrolled in high school in this
3232 state;] and
3333 (2) [(3)] does not reside in this state due to a
3434 military deployment or transfer.
3535 SECTION 2. Section 30A.002(b), Education Code, is repealed.
3636 SECTION 3. This Act applies beginning with the 2017-2018
3737 school year.
3838 SECTION 4. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect September 1, 2017.
