| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 39.082, Education Code, is amended by |
|---|
| 13 | 13 | | adding Subsection (e-1) to read as follows: |
|---|
| 14 | 14 | | (e-1) The financial performance of a charter school |
|---|
| 15 | 15 | | operated by a public institution of higher education under |
|---|
| 16 | 16 | | Subchapter D or E, Chapter 12, shall be evaluated using only the |
|---|
| 17 | 17 | | indicators adopted under this section determined by the |
|---|
| 18 | 18 | | commissioner by rule as appropriate to accurately measure the |
|---|
| 19 | 19 | | financial performance of such charter schools. |
|---|
| 20 | 20 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 21 | 21 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 22 | 22 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 23 | 23 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 24 | 24 | | Act takes effect September 1, 2017. |
