115 relating to the duties of the structural pest control advisory
126 committee.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Section 1951.104, Occupations Code, is amended
159 to read as follows:
1610 Sec. 1951.104. DUTIES OF COMMITTEE. (a) The committee
1711 shall:
1812 (1) gather and provide information relating to the
1913 practice of structural pest control at the request of the
2014 department or the commissioner; and
2115 (2) advise the department and the commissioner on:
2216 (A) the education and curricula requirements for
2317 applicants;
2418 (B) the content of examinations under this
2519 chapter;
2620 (C) proposed rules and standards on technical
2721 issues related to structural pest control and rules related to
2822 enforcement;
2923 (D) standards and criteria for the issuance of
3024 licenses under this chapter;
3125 (E) fees for license applications and
3226 examinations under this chapter; and
3327 (F) other issues affecting the practice of
3428 structural pest control.
3529 (b) Before the department proposes a rule for adoption, the
3630 department must submit the proposed rule to the committee to
3731 provide advice as described by Subsection (a)(2)(C). The committee
3832 shall:
3933 (1) vote on whether to recommend that the rule be
4034 proposed for adoption; and
4135 (2) provide the recommendation under Subdivision (1)
4236 to the department not later than the 60th day after the date the
4337 proposed rule was submitted to the committee for review.
4438 (c) For the purpose of advising the department on rules
4539 related to enforcement under Subsection (a), on request of the
4640 presiding officer of the committee, the department shall allow the
4741 committee to review a completed disciplinary investigation file.
4842 SECTION 2. Section 1951.105, Occupations Code, is amended
4943 by amending Subsection (b) and adding Subsection (c) to read as
5044 follows:
5145 (b) The committee shall:
5246 (1) at the first meeting of each year, elect from the
5347 committee's members a presiding officer and an assistant presiding
5448 officer to serve a term of one year;
5549 (2) meet quarterly;
5650 (3) [(2)] operate under Robert's Rules of Order; and
5751 (4) [(3)] record the minutes of each meeting.
5852 (c) The rules adopted under Subsection (a) must provide that
5953 the presiding officer of the committee:
6054 (1) is responsible for setting an agenda for each
6155 committee meeting; and
6256 (2) may add an item to an agenda on request by the
6357 department or commissioner.
6458 SECTION 3. This Act takes effect September 1, 2017.
