13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 8 | | SECTION 1. Section 1951.104, Occupations Code, is amended |
---|
15 | 9 | | to read as follows: |
---|
16 | 10 | | Sec. 1951.104. DUTIES OF COMMITTEE. (a) The committee |
---|
17 | 11 | | shall: |
---|
18 | 12 | | (1) gather and provide information relating to the |
---|
19 | 13 | | practice of structural pest control at the request of the |
---|
20 | 14 | | department or the commissioner; and |
---|
21 | 15 | | (2) advise the department and the commissioner on: |
---|
22 | 16 | | (A) the education and curricula requirements for |
---|
23 | 17 | | applicants; |
---|
24 | 18 | | (B) the content of examinations under this |
---|
25 | 19 | | chapter; |
---|
26 | 20 | | (C) proposed rules and standards on technical |
---|
27 | 21 | | issues related to structural pest control and rules related to |
---|
28 | 22 | | enforcement; |
---|
29 | 23 | | (D) standards and criteria for the issuance of |
---|
30 | 24 | | licenses under this chapter; |
---|
31 | 25 | | (E) fees for license applications and |
---|
32 | 26 | | examinations under this chapter; and |
---|
33 | 27 | | (F) other issues affecting the practice of |
---|
34 | 28 | | structural pest control. |
---|
35 | 29 | | (b) Before the department proposes a rule for adoption, the |
---|
36 | 30 | | department must submit the proposed rule to the committee to |
---|
37 | 31 | | provide advice as described by Subsection (a)(2)(C). The committee |
---|
38 | 32 | | shall: |
---|
39 | 33 | | (1) vote on whether to recommend that the rule be |
---|
40 | 34 | | proposed for adoption; and |
---|
41 | 35 | | (2) provide the recommendation under Subdivision (1) |
---|
42 | 36 | | to the department not later than the 60th day after the date the |
---|
43 | 37 | | proposed rule was submitted to the committee for review. |
---|
44 | 38 | | (c) For the purpose of advising the department on rules |
---|
45 | 39 | | related to enforcement under Subsection (a), on request of the |
---|
46 | 40 | | presiding officer of the committee, the department shall allow the |
---|
47 | 41 | | committee to review a completed disciplinary investigation file. |
---|
48 | 42 | | SECTION 2. Section 1951.105, Occupations Code, is amended |
---|
49 | 43 | | by amending Subsection (b) and adding Subsection (c) to read as |
---|
50 | 44 | | follows: |
---|
51 | 45 | | (b) The committee shall: |
---|
52 | 46 | | (1) at the first meeting of each year, elect from the |
---|
53 | 47 | | committee's members a presiding officer and an assistant presiding |
---|
54 | 48 | | officer to serve a term of one year; |
---|
55 | 49 | | (2) meet quarterly; |
---|
56 | 50 | | (3) [(2)] operate under Robert's Rules of Order; and |
---|
57 | 51 | | (4) [(3)] record the minutes of each meeting. |
---|
58 | 52 | | (c) The rules adopted under Subsection (a) must provide that |
---|
59 | 53 | | the presiding officer of the committee: |
---|
60 | 54 | | (1) is responsible for setting an agenda for each |
---|
61 | 55 | | committee meeting; and |
---|
62 | 56 | | (2) may add an item to an agenda on request by the |
---|
63 | 57 | | department or commissioner. |
---|
64 | 58 | | SECTION 3. This Act takes effect September 1, 2017. |
