| 7 | 7 | | relating to the definition of distinguished researcher for purposes |

| 8 | 8 | | of the governor's university research initiative. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 62.161(1), Education Code, as added by |
|---|
| 11 | 11 | | Chapters 323 (S.B. 632) and 915 (H.B. 26), Acts of the 84th |
|---|
| 12 | 12 | | Legislature, Regular Session, 2015, is amended to read as follows: |
|---|
| 13 | 13 | | (1) "Distinguished researcher" means a researcher who |
|---|
| 14 | 14 | | is: |
|---|
| 15 | 15 | | (A) a Nobel laureate or the recipient of an |
|---|
| 16 | 16 | | equivalent honor; [or] |
|---|
| 17 | 17 | | (B) a member of a national honorific society, |
|---|
| 18 | 18 | | such as the National Academy of Sciences, the National Academy of |
|---|
| 19 | 19 | | Engineering, or the National Academy of Medicine, formerly known as |
|---|
| 20 | 20 | | the Institute of Medicine, or an equivalent honorific organization; |
|---|
| 21 | 21 | | or |
|---|
| 22 | 22 | | (C) the principal investigator for a research |
|---|
| 23 | 23 | | project or other research for which expenditures of at least $1 |
|---|
| 24 | 24 | | million have been made for each of the preceding three years. |

| 25 | 25 | | SECTION 2. Section 62.161(2), Education Code, as added by |
|---|
| 26 | 26 | | Chapter 448 (H.B. 7), Acts of the 84th Legislature, Regular |
|---|
| 27 | 27 | | Session, 2015, is amended to read as follows: |
|---|
| 28 | 28 | | (2) "Distinguished researcher" means a researcher who |
|---|
| 29 | 29 | | is: |
|---|
| 30 | 30 | | (A) a Nobel laureate or the recipient of an |
|---|
| 31 | 31 | | equivalent honor; [or] |
|---|
| 32 | 32 | | (B) a member of a national honorific society, |
|---|
| 33 | 33 | | such as the National Academy of Sciences, the National Academy of |
|---|
| 34 | 34 | | Engineering, or the National Academy of Medicine, formerly known as |
|---|
| 35 | 35 | | the Institute of Medicine, or an equivalent honorific organization; |

| 40 | 40 | | SECTION 3. The changes in law made by this Act apply only to |
|---|
| 41 | 41 | | an application for receipt of a matching grant from the governor's |
|---|
| 42 | 42 | | university research initiative that is submitted on or after the |
|---|
| 43 | 43 | | effective date of this Act. An application for receipt of a |
|---|
| 44 | 44 | | matching grant from the governor's university research initiative |
|---|
| 45 | 45 | | that is submitted before the effective date of this Act is governed |
|---|
| 46 | 46 | | by the law in effect on the date the application is submitted, and |
|---|
| 47 | 47 | | the former law is continued in effect for that purpose. |
|---|
| 48 | 48 | | SECTION 4. This Act takes effect September 1, 2017. |
