1010 relating to the authority to establish a customer assistance
1111 program for certain municipally owned utilities.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter Z, Chapter 552, Local Government
1414 Code, is amended by adding Section 552.916 to read as follows:
1515 Sec. 552.916. CUSTOMER ASSISTANCE PROGRAM AUTHORITY FOR
1616 CERTAIN UTILITIES. (a) This section applies only to a board of
1717 trustees described by Section 1502.070(a)(2)(B), Government Code.
1818 (b) A board of trustees has the exclusive authority to
1919 establish a bill payment assistance program for its utility
2020 system's customers:
2121 (1) who received notice of disconnection of service
2222 for nonpayment of bills; or
2323 (2) who the utility determines are low-income
2424 customers.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2017.
