12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Subchapter Z, Chapter 552, Local Government |
---|
14 | 14 | | Code, is amended by adding Section 552.916 to read as follows: |

15 | 15 | | Sec. 552.916. CUSTOMER ASSISTANCE PROGRAM AUTHORITY FOR |
---|
16 | 16 | | CERTAIN UTILITIES. (a) This section applies only to a board of |
---|
17 | 17 | | trustees described by Section 1502.070(a)(2)(B), Government Code. |
---|
18 | 18 | | (b) A board of trustees has the exclusive authority to |
---|
19 | 19 | | establish a bill payment assistance program for its utility |
---|
20 | 20 | | system's customers: |
---|
21 | 21 | | (1) who received notice of disconnection of service |
---|
22 | 22 | | for nonpayment of bills; or |
---|
23 | 23 | | (2) who the utility determines are low-income |
---|
24 | 24 | | customers. |
---|
25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
---|
26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
---|
27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
---|
29 | 29 | | Act takes effect September 1, 2017. |
