8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 105.04, Alcoholic Beverage Code, is | |
10 | 10 | amended to read as follows: | |
11 | 11 | Sec. 105.04. HOURS OF SALE: WINE AND BEER RETAILER. The | |
12 | 12 | hours of sale and delivery for alcoholic beverages sold under a wine | |
13 | 13 | and beer retailer's permit or a wine and beer retailer's off-premise | |
14 | 14 | permit are the same as those prescribed for the sale of beer under | |
15 | 15 | Section 105.05 [of this code, except that no sale shall be allowed | |
16 | 16 | between 2 a.m. and noon on Sunday]. | |
17 | 17 | SECTION 2. Section 105.05(b), Alcoholic Beverage Code, is | |
18 | 18 | amended to read as follows: | |
19 | 19 | (b) A person may sell, offer for sale, or deliver beer | |
20 | 20 | between 7 a.m. and midnight on any day except Sunday. On Sunday a | |
21 | 21 | person [he] may sell beer between midnight and 1:00 a.m. and between | |
22 | 22 | noon and midnight, except that: | |
23 | 23 | (1) permittees or licensees authorized to sell for | |
24 | 24 | on-premise consumption may sell beer between 10:00 a.m. and noon if | |
25 | 25 | the beer is served to a customer during the service of food to the | |
26 | 26 | customer; and | |
27 | 27 | (2) holders of a wine and beer retailer's off-premise | |
28 | 28 | permit may also sell beer between 7:00 a.m. and noon. | |
29 | 29 | SECTION 3. This Act takes effect September 1, 2017. |
