| 7 | 7 | | relating to breast-feeding policies of state agency worksites. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 165.003, Health and Safety Code, is |
|---|
| 10 | 10 | | amended by adding Subsection (c) to read as follows: |
|---|
| 11 | 11 | | (c) The department shall annually submit a list of state |
|---|
| 12 | 12 | | agencies that are included on the list of "mother-friendly" |
|---|
| 13 | 13 | | businesses maintained under Subsection (b) to the standing |
|---|
| 14 | 14 | | committees of the house and senate with jurisdiction over the |
|---|
| 15 | 15 | | department. |
|---|
| 16 | 16 | | SECTION 2. Subchapter A, Chapter 165, Health and Safety |
|---|
| 17 | 17 | | Code, is amended by adding Section 165.0035 to read as follows: |
|---|
| 18 | 18 | | Sec. 165.0035. STATE AGENCY "MOTHER-FRIENDLY" WORKSITE. |
|---|
| 19 | 19 | | (a) In this section, "state agency" means a board, commission, |
|---|
| 20 | 20 | | office, department, or other agency in the executive, judicial, or |
|---|
| 21 | 21 | | legislative branch of state government, including an institution of |
|---|
| 22 | 22 | | higher education as defined by Section 61.003, Education Code. |
|---|
| 23 | 23 | | (b) To the extent reasonably practicable, each state agency |
|---|
| 24 | 24 | | shall develop a policy supporting the practice of worksite |
|---|
| 25 | 25 | | breast-feeding under Section 165.003 and submit its policy to the |
|---|
| 26 | 26 | | department. |
|---|
| 27 | 27 | | (c) The department shall include each state agency that |
|---|
| 28 | 28 | | develops a policy under this section on the list of |
|---|
| 29 | 29 | | "mother-friendly" businesses under Section 165.003. |
|---|
| 30 | 30 | | SECTION 3. A state agency shall comply with Section |
|---|
| 31 | 31 | | 165.0035, Health and Safety Code, as added by this Act, not later |
|---|
| 32 | 32 | | than September 1, 2019. |
|---|
| 33 | 33 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2017. |
