98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. Section 5A(a)(4), Chapter 1507 (S.B. 456), Acts
1110 of the 76th Legislature, Regular Session, 1999 (Article 5190.14,
1211 Vernon's Texas Civil Statutes), is amended to read as follows:
1312 (4) "Event" means a Super Bowl, a National Collegiate
1413 Athletic Association Final Four tournament game, the National
1514 Basketball Association All-Star Game, the X Games, the National
1615 Hockey League All-Star Game, the Major League Baseball All-Star
1716 Game, a game of the National Collegiate Athletic Association Bowl
1817 Championship Series or its successor or a National Collegiate
1918 Athletic Association Division I Football Bowl Subdivision
2019 postseason playoff or championship game, the National Collegiate
2120 Athletic Association men's or women's lacrosse championships, a
2221 World Cup Soccer game, the World Cup soccer tournament, the Major
2322 League Soccer All-Star Game, the Major League Soccer Cup, the
2423 Professional Rodeo Cowboys Association National Finals Rodeo, an
2524 Elite Rodeo Association World Championship, the United States Open
2625 Championship, the World Games, a national collegiate championship
2726 of an amateur sport sanctioned by the national governing body of the
2827 sport that is recognized by the United States Olympic Committee, an
2928 Olympic activity, including a Junior or Senior activity, training
3029 program, or feeder program sanctioned by the United States Olympic
3130 Committee's Community Olympic Development Program, the Amateur
3231 Athletic Union Junior Olympic Games, a mixed martial arts
3332 championship, the Breeders' Cup World Championships, a Formula One
3433 automobile race, the Moto Grand Prix of the United States, the
3534 National Association for Stock Car Auto Racing (NASCAR) All-Star
3635 Race, the season-ending Championship Race for the National
3736 Association for Stock Car Auto Racing (NASCAR), the Academy of
3837 Country Music Awards, the National Cutting Horse Association Triple
3938 Crown, a national political convention of the Republican National
4039 Committee or the Democratic National Committee, a presidential
4140 general election debate, or the largest event held each year at a
4241 sports entertainment venue in this state with a permanent seating
4342 capacity, including grandstand and premium seating, of not less
4443 than 125,000. The term includes any activities related to or
4544 associated with an event.
46- SECTION 2. The change in law made by this Act applies only
45+ SECTION 2. Section 5A, Chapter 1507 (S.B. 456), Acts of the
46+ 76th Legislature, Regular Session, 1999 (Article 5190.14, Vernon's
47+ Texas Civil Statutes), is amended by amending Subsection (a-1) and
48+ adding Subsection (a-4) to read as follows:
49+ (a-1) An event not listed in Subsection (a)(4) of this
50+ section is ineligible for funding under this section. A listed
51+ event may receive funding through the Major Events Reimbursement
52+ Program under this section only if:
53+ (1) a site selection organization selects a site
54+ located in this state for the event to be held one time or, for an
55+ event scheduled to be held each year for a period of years under an
56+ event contract, or an event support contract, one time each year for
57+ the period of years, after considering, through a highly
58+ competitive selection process, one or more sites that are not
59+ located in this state;
60+ (2) a site selection organization selects a site in
61+ this state as:
62+ (A) the sole site for the event; or
63+ (B) the sole site for the event in a region
64+ composed of this state and one or more adjoining states;
65+ (3) the event is held not more than one time in any
66+ year; [and]
67+ (4) the amount of the incremental increase in tax
68+ receipts determined by the department under Subsection (b) of this
69+ section equals or exceeds $1 million, provided that for an event
70+ scheduled to be held each year for a period of years under an event
71+ contract or event support contract, the incremental increase in tax
72+ receipts shall be calculated as if the event did not occur in the
73+ prior year; and
74+ (5) not later than the 30th day before the first day of
75+ the event, a site selection organization submits a plan to prevent
76+ the trafficking of persons in connection with the event to the
77+ office of the attorney general and the chief of the Texas Division
78+ of Emergency Management.
79+ (a-4) The office of the attorney general may:
80+ (1) distribute the plan required under Subsection
81+ (a-1)(5) of this section to appropriate law enforcement agencies
82+ and to the office of the governor; and
83+ (2) publish the plan on the office's Internet website.
84+ SECTION 3. The change in law made by this Act applies only
4785 to a request submitted by a local organizing committee, endorsing
4886 municipality, or endorsing county under Section 5A, Chapter 1507
4987 (S.B. 456), Acts of the 76th Legislature, Regular Session, 1999
5088 (Article 5190.14, Vernon's Texas Civil Statutes), on or after the
5189 effective date of this Act. A request submitted under Section 5A
5290 before that date is governed by the law in effect on the date the
5391 request is submitted, and that law is continued in effect for that
5492 purpose.
55- SECTION 3. This Act takes effect immediately if it receives
93+ SECTION 4. This Act takes effect immediately if it receives
5694 a vote of two-thirds of all the members elected to each house, as
5795 provided by Section 39, Article III, Texas Constitution. If this
5896 Act does not receive the vote necessary for immediate effect, this
5997 Act takes effect September 1, 2017.
