77 relating to prohibiting certain discrimination against a physician
88 or an applicant for a license to practice medicine in this state.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 241.003, Health and Safety Code, is
1111 amended by adding Subdivisions (7-a) and (16) to read as follows:
1212 (7-a) "Maintenance of certification" has the meaning
1313 assigned by Section 151.002, Occupations Code.
1414 (16) "Specialty medical board certification" has the
1515 meaning assigned by Section 151.002, Occupations Code.
1616 SECTION 2. Subchapter A, Chapter 241, Health and Safety
1717 Code, is amended by adding Section 241.011 to read as follows:
1818 Sec. 241.011. DISCRIMINATION AGAINST PHYSICIAN BASED ON
1919 SPECIALTY MEDICAL BOARD CERTIFICATION OR MAINTENANCE OF
2020 CERTIFICATION. Notwithstanding any other law, the owner, operator,
2121 or governing body of a hospital that is licensed in this state may
2222 not:
2323 (1) require a physician to obtain or maintain any form
2424 of specialty medical board certification or maintenance of
2525 certification to be eligible for medical staff membership or
2626 professional privileges, including admitting privileges; or
2727 (2) discriminate against, disfavor, or disadvantage a
2828 physician who does not obtain or maintain specialty medical board
2929 certification or maintenance of certification.
3030 SECTION 3. Subtitle F, Title 8, Insurance Code, is amended
3131 by adding Chapter 1461 to read as follows:
3232 CHAPTER 1461. DISCRIMINATION AGAINST PHYSICIAN BASED ON MEDICAL
3333 SPECIALTY BOARD CERTIFICATION OR MAINTENANCE OF CERTIFICATION
3434 Sec. 1461.001. DEFINITIONS. In this chapter:
3535 (1) "Enrollee" means an individual who is eligible to
3636 receive health care services under a managed care plan.
3737 (2) "Maintenance of certification" has the meaning
3838 assigned by Section 151.002, Occupations Code.
3939 (3) "Managed care plan" means a health benefit plan
4040 under which medical care services are provided to enrollees through
4141 contracts with physicians and that requires enrollees to use
4242 participating physicians or that provides a different level of
4343 coverage for enrollees who use participating physicians. The term
4444 includes a health benefit plan issued by:
4545 (A) a health maintenance organization;
4646 (B) a preferred provider benefit plan issuer; or
4747 (C) any other entity that issues a health benefit
4848 plan, including an insurance company.
4949 (4) "Participating physician" means a physician who
5050 has directly or indirectly contracted with a health benefit plan
5151 issuer to provide services to enrollees.
5252 (5) "Physician" means a person licensed to practice
5353 medicine in this state.
5454 (6) "Specialty medical board certification" has the
5555 meaning assigned by Section 151.002, Occupations Code.
5656 Sec. 1461.002. APPLICABILITY. (a) This chapter applies to
5757 a physician regardless of whether the physician is a participating
5858 physician.
5959 (b) This chapter applies to a person with whom a managed
6060 care plan issuer contracts to:
6161 (1) process or pay claims;
6262 (2) obtain the services of physicians to provide
6363 medical care services to enrollees; or
6464 (3) issue verifications or preauthorizations.
6565 Sec. 1461.003. DISCRIMINATION AGAINST PHYSICIAN BASED ON
6666 SPECIALTY MEDICAL BOARD CERTIFICATION, MAINTENANCE OF
6767 CERTIFICATION, OR STAFF PRIVILEGES. Notwithstanding any other law,
6868 a managed care plan issuer may not:
6969 (1) require for the payment or reimbursement of a
7070 claim under the plan that a physician:
7171 (A) obtain or maintain any form of specialty
7272 medical board certification or maintenance of certification; or
7373 (B) maintain hospital medical staff privileges;
7474 or
7575 (2) discriminate against, disfavor, or disadvantage a
7676 physician who does not obtain or maintain specialty medical board
7777 certification or maintenance of certification.
7878 SECTION 4. Section 151.002(a), Occupations Code, is amended
7979 by adding Subdivisions (6-b) and (13-a) to read as follows:
8080 (6-b) "Maintenance of certification" means a process
8181 of successful completion of periodic recertification examinations
8282 that are required to maintain specialty medical board
8383 certification.
8484 (13-a) "Specialty medical board certification" means
8585 certification by a board that specializes in one particular area of
8686 medicine and typically requires additional and more strenuous
8787 examinations than state licensing boards require to practice
8888 medicine.
8989 SECTION 5. Chapter 151, Occupations Code, is amended by
9090 adding Subchapter C to read as follows:
9191 SUBCHAPTER C. DISCRIMINATION AGAINST PHYSICIAN BASED ON MEDICAL
9292 SPECIALTY BOARD CERTIFICATION OR MAINTENANCE OF CERTIFICATION
9393 Sec. 151.101. DISCRIMINATION REGARDING PRACTICE OF
9494 MEDICINE PROHIBITED. Notwithstanding any other law, the board may
9595 not:
9696 (1) require any form of specialty medical board
9797 certification or maintenance of certification to practice medicine
9898 in this state; or
9999 (2) require any form of specialty medical board
100100 certification or maintenance of certification for a person to be
101101 eligible under this subtitle for:
102102 (A) a license; or
103103 (B) an initial or renewal registration permit.
104104 Sec. 151.102. DISCRIMINATION BY STATE AGENCY PROHIBITED.
105105 Notwithstanding any other law the board or another state agency may
106106 not discriminate against, disfavor, or disadvantage a physician who
107107 does not obtain or maintain specialty medical board certification
108108 or maintenance of certification.
109109 Sec. 151.103. DISCRIMINATION IN COMPACT PROHIBITED.
110110 Notwithstanding any other law the board or another state agency may
111111 not enter into a compact, including an interstate compact, that
112112 discriminates against, disfavors, or disadvantages a physician who
113113 does not obtain or maintain specialty medical board certification
114114 or maintenance of certification.
115115 SECTION 6. This Act takes effect September 1, 2017.
