66 AN ACT
77 relating to the authorized locations for certain tastings and
88 evaluations of home-produced alcoholic beverages.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 12, Alcoholic Beverage Code, is amended
1111 by adding Section 12.08 to read as follows:
1212 Sec. 12.08. TASTING COMPETITION. (a) The holder of a
1313 brewer's permit described by Section 12.052 may hold a tasting
1414 competition on the brewer's premises that includes the consumption
1515 but not the sale of malt liquor produced by a person who is
1616 authorized under Section 109.21(a) to produce the malt liquor.
1717 (b) The holder of a brewer's permit who holds a tasting
1818 competition under Subsection (a) must file a surety bond in the
1919 amount of $500.
2020 SECTION 2. Subchapter A, Chapter 27, Alcoholic Beverage
2121 Code, is amended by adding Section 27.012 to read as follows:
2222 Sec. 27.012. TASTING COMPETITION. (a) The holder of a
2323 temporary wine and beer retailer's permit may hold a tasting
2424 competition on the premises for which the permit is issued that
2525 includes the consumption but not the sale of beer or malt liquor and
2626 produced by a person who is authorized under Section 109.21(a) to
2727 produce the beer or malt liquor.
2828 (b) The holder of a temporary wine and beer retailer's
2929 permit who holds a tasting competition under Subsection (a) must
3030 file a surety bond in the amount of $500.
3131 SECTION 3. Subchapter B, Chapter 27, Alcoholic Beverage
3232 Code, is amended by adding Section 27.111 to read as follows:
3333 Sec. 27.111. TASTING COMPETITION. (a) The holder of a
3434 special three-day wine and beer permit may hold a tasting
3535 competition on the premises for which the permit is issued that
3636 includes the consumption but not the sale of beer or malt liquor
3737 produced by a person who is authorized under Section 109.21(a) to
3838 produce the beer or malt liquor.
3939 (b) The holder of a special three-day wine and beer permit
4040 who holds a tasting competition under Subsection (a) must file a
4141 surety bond in the amount of $500.
4242 SECTION 4. Chapter 62, Alcoholic Beverage Code, is amended
4343 by adding Section 62.15 to read as follows:
4444 Sec. 62.15. TASTING COMPETITION. (a) The holder of a
4545 manufacturer's license described by Section 62.122 may hold a
4646 tasting competition on the manufacturer's premises that includes
4747 the consumption but not the sale of beer produced by a person who is
4848 authorized under Section 109.21(a) to produce the beer.
4949 (b) The holder of a manufacturer's license who holds a
5050 tasting competition under Subsection (a) must file a surety bond in
5151 the amount of $500.
5252 SECTION 5. Chapter 74, Alcoholic Beverage Code, is amended
5353 by adding Section 74.12 to read as follows:
5454 Sec. 74.12. TASTING COMPETITION. (a) The holder of a
5555 brewpub license may hold a tasting competition on the brewpub's
5656 premises that includes the consumption but not the sale of beer or
5757 malt liquor produced by a person who is authorized under Section
5858 109.21(a) to produce the beer or malt liquor.
5959 (b) The holder of a brewpub license who holds a tasting
6060 competition under Subsection (a) must file a surety bond in the
6161 amount of $500.
6262 SECTION 6. Section 109.22(b), Alcoholic Beverage Code, is
6363 amended to read as follows:
6464 (b) For the purpose of participating in an organized
6565 tasting, evaluation, competition, or literary review, a person to
6666 whom this section applies may deliver wine, ale, malt liquor, or
6767 beer produced and manufactured by the person to locations that are
6868 not permitted or licensed under this code or, as provided by Section
6969 12.08, 27.012, 27.111, 62.15, or 74.12, to a permitted or licensed
7070 premises, for the purpose of submitting those products to an
7171 evaluation at an organized tasting competition that is closed to
7272 the general public or by a reviewer whose reviews are published if[:
7373 [(1)] no charge of any kind is made for the wine, ale,
7474 malt liquor, or beer, for its delivery, or for attendance at the
7575 event[; and
7676 [(2) the commission consents in writing to the
7777 delivery].
7878 SECTION 7. This Act takes effect September 1, 2017.
