| 7 | 7 | | relating to the authorized locations for certain tastings and |

| 8 | 8 | | evaluations of home-produced alcoholic beverages. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 12, Alcoholic Beverage Code, is amended |
|---|
| 11 | 11 | | by adding Section 12.08 to read as follows: |
|---|
| 12 | 12 | | Sec. 12.08. TASTING COMPETITION. (a) The holder of a |
|---|
| 13 | 13 | | brewer's permit described by Section 12.052 may hold a tasting |
|---|
| 14 | 14 | | competition on the brewer's premises that includes the consumption |
|---|
| 15 | 15 | | but not the sale of malt liquor produced by a person who is |
|---|
| 16 | 16 | | authorized under Section 109.21(a) to produce the malt liquor. |
|---|
| 17 | 17 | | (b) The holder of a brewer's permit who holds a tasting |
|---|
| 18 | 18 | | competition under Subsection (a) must file a surety bond in the |
|---|
| 19 | 19 | | amount of $500. |
|---|
| 20 | 20 | | SECTION 2. Subchapter A, Chapter 27, Alcoholic Beverage |
|---|
| 21 | 21 | | Code, is amended by adding Section 27.012 to read as follows: |
|---|
| 22 | 22 | | Sec. 27.012. TASTING COMPETITION. (a) The holder of a |
|---|
| 23 | 23 | | temporary wine and beer retailer's permit may hold a tasting |
|---|
| 24 | 24 | | competition on the premises for which the permit is issued that |
|---|
| 25 | 25 | | includes the consumption but not the sale of beer or malt liquor and |
|---|
| 26 | 26 | | produced by a person who is authorized under Section 109.21(a) to |
|---|
| 27 | 27 | | produce the beer or malt liquor. |
|---|
| 28 | 28 | | (b) The holder of a temporary wine and beer retailer's |
|---|
| 29 | 29 | | permit who holds a tasting competition under Subsection (a) must |
|---|
| 30 | 30 | | file a surety bond in the amount of $500. |

| 31 | 31 | | SECTION 3. Subchapter B, Chapter 27, Alcoholic Beverage |
|---|
| 32 | 32 | | Code, is amended by adding Section 27.111 to read as follows: |

| 33 | 33 | | Sec. 27.111. TASTING COMPETITION. (a) The holder of a |
|---|
| 34 | 34 | | special three-day wine and beer permit may hold a tasting |
|---|
| 35 | 35 | | competition on the premises for which the permit is issued that |
|---|
| 36 | 36 | | includes the consumption but not the sale of beer or malt liquor |
|---|
| 37 | 37 | | produced by a person who is authorized under Section 109.21(a) to |
|---|
| 38 | 38 | | produce the beer or malt liquor. |
|---|
| 39 | 39 | | (b) The holder of a special three-day wine and beer permit |
|---|
| 40 | 40 | | who holds a tasting competition under Subsection (a) must file a |
|---|
| 41 | 41 | | surety bond in the amount of $500. |
|---|
| 42 | 42 | | SECTION 4. Chapter 62, Alcoholic Beverage Code, is amended |
|---|
| 43 | 43 | | by adding Section 62.15 to read as follows: |
|---|
| 44 | 44 | | Sec. 62.15. TASTING COMPETITION. (a) The holder of a |
|---|
| 45 | 45 | | manufacturer's license described by Section 62.122 may hold a |
|---|
| 46 | 46 | | tasting competition on the manufacturer's premises that includes |
|---|
| 47 | 47 | | the consumption but not the sale of beer produced by a person who is |
|---|
| 48 | 48 | | authorized under Section 109.21(a) to produce the beer. |
|---|
| 49 | 49 | | (b) The holder of a manufacturer's license who holds a |
|---|
| 50 | 50 | | tasting competition under Subsection (a) must file a surety bond in |
|---|
| 51 | 51 | | the amount of $500. |
|---|
| 52 | 52 | | SECTION 5. Chapter 74, Alcoholic Beverage Code, is amended |
|---|
| 53 | 53 | | by adding Section 74.12 to read as follows: |
|---|
| 54 | 54 | | Sec. 74.12. TASTING COMPETITION. (a) The holder of a |
|---|
| 55 | 55 | | brewpub license may hold a tasting competition on the brewpub's |
|---|
| 56 | 56 | | premises that includes the consumption but not the sale of beer or |
|---|
| 57 | 57 | | malt liquor produced by a person who is authorized under Section |
|---|
| 58 | 58 | | 109.21(a) to produce the beer or malt liquor. |
|---|
| 59 | 59 | | (b) The holder of a brewpub license who holds a tasting |
|---|
| 60 | 60 | | competition under Subsection (a) must file a surety bond in the |
|---|
| 61 | 61 | | amount of $500. |
|---|
| 62 | 62 | | SECTION 6. Section 109.22(b), Alcoholic Beverage Code, is |
|---|
| 63 | 63 | | amended to read as follows: |
|---|
| 64 | 64 | | (b) For the purpose of participating in an organized |
|---|
| 65 | 65 | | tasting, evaluation, competition, or literary review, a person to |
|---|
| 66 | 66 | | whom this section applies may deliver wine, ale, malt liquor, or |
|---|
| 67 | 67 | | beer produced and manufactured by the person to locations that are |
|---|
| 68 | 68 | | not permitted or licensed under this code or, as provided by Section |
|---|
| 69 | 69 | | 12.08, 27.012, 27.111, 62.15, or 74.12, to a permitted or licensed |
|---|
| 70 | 70 | | premises, for the purpose of submitting those products to an |
|---|
| 71 | 71 | | evaluation at an organized tasting competition that is closed to |
|---|
| 72 | 72 | | the general public or by a reviewer whose reviews are published if[: |
|---|
| 73 | 73 | | [(1)] no charge of any kind is made for the wine, ale, |
|---|
| 74 | 74 | | malt liquor, or beer, for its delivery, or for attendance at the |
|---|
| 75 | 75 | | event[; and |
|---|
| 76 | 76 | | [(2) the commission consents in writing to the |
|---|
| 77 | 77 | | delivery]. |
|---|
| 78 | 78 | | SECTION 7. This Act takes effect September 1, 2017. |
