| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 552.135, Government Code, is amended by | |
| 11 | 11 | adding Subsection (d-1) to read as follows: | |
| 12 | 12 | (d-1) Except as provided by Subsection (e) and Section | |
| 13 | 13 | 552.108, information excepted under Subsection (b) shall be made | |
| 14 | 14 | available to an employee or former employee who is the subject of a | |
| 15 | 15 | report made by an informer if the report is used as the basis for the | |
| 16 | 16 | evaluation of or a disciplinary action against the employee or | |
| 17 | 17 | former employee. | |
| 18 | 18 | SECTION 2. This Act takes effect immediately if it receives | |
| 19 | 19 | a vote of two-thirds of all the members elected to each house, as | |
| 20 | 20 | provided by Section 39, Article III, Texas Constitution. If this | |
| 21 | 21 | Act does not receive the vote necessary for immediate effect, this | |
| 22 | 22 | Act takes effect September 1, 2017. |
