68 AN ACT
79 relating to the evaluation of and improvements to the quality of the
810 Texas Workforce Commission's subsidized child care program.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Section 302.0042, Labor Code, is amended by
1113 amending Subsection (b) and adding Subsection (c) to read as
1214 follows:
1315 (b) The commission's evaluation must assess:
1416 (1) the use of current federal child care funds by each
1517 local workforce development board;
1618 (2) the ability of each local workforce development
1719 board to meet child care performance measures;
1820 (3) the estimated [average] cost incurred by child
1921 care providers [of child care] in each local workforce development
2022 area as stated in the report required under 45 C.F.R. Section
2123 98.45(f)(1);
2224 (4) the average price charged by child care providers
2325 for child care in each local workforce development area as stated in
2426 the market rate survey conducted under 45 C.F.R. Section 98.45(c);
2527 (5) the poverty rate of each local workforce
2628 development area compared to the state's poverty rate;
2729 (6) [(5)] the number of children on waiting lists for
2830 child care in each local workforce development area; [and]
2931 (7) [(6)] the number of places that are reserved for
3032 participants in the child care subsidy program out of the total
3133 number of children enrolled with a provider on a full-time basis
3234 categorized by age of the child for each provider [vacant slots
3335 available for child care placement] in each local workforce
3436 development area that is certified as a 2-star, 3-star, or 4-star
3537 provider in the Texas Rising Star Program or that does not
3638 participate in the Texas Rising Star Program;
3739 (8) the total number of child care providers
3840 participating in the Texas Rising Star Program in each local
3941 workforce development area and the number of 2-star, 3-star, and
4042 4-star rated child care providers in the local workforce
4143 development area;
4244 (9) the number of child care providers participating
4345 in the Texas Rising Star Program in each local workforce
4446 development area as a percentage of the total number of subsidized
4547 child care providers in the local workforce development area and
4648 the number of 2-star, 3-star, and 4-star rated child care providers
4749 in the local workforce development area as a percentage of the total
4850 number of subsidized child care providers in the local workforce
4951 development area;
5052 (10) the total number of children enrolled in
5153 subsidized child care providers participating in the Texas Rising
5254 Star Program in each local workforce development area and the
5355 number of subsidized children enrolled in 2-star, 3-star, and
5456 4-star rated child care providers in the local workforce
5557 development area; and
5658 (11) the number of subsidized children enrolled in
5759 child care providers participating in the Texas Rising Star Program
5860 in each local workforce development area as a percentage of the
5961 total number of subsidized children enrolled in child care
6062 providers in the local workforce development area and the number of
6163 subsidized children enrolled in 2-star, 3-star, and 4-star rated
6264 child care providers in the local workforce development area as a
6365 percentage of the total number of subsidized children enrolled in
6466 child care providers in the local workforce development area.
6567 (c) For the purposes of evaluation under this section, the
6668 commission shall annually update the information described by
6769 Subsections (b)(6)-(11).
6870 SECTION 2. Section 302.0043, Labor Code, is amended by
6971 adding Subsection (c-1) and amending Subsections (e) and (f) to
7072 read as follows:
7173 (c-1) The commission shall measure and evaluate the
7274 progress of the commission's child care program regarding:
7375 (1) coordination by the commission with the Texas
7476 Education Agency to assign a Public Education Information
7577 Management System (PEIMS) number to children younger than six years
7678 of age enrolled in the commission's child care program;
7779 (2) coordination with the Texas Education Agency,
7880 school districts, and open-enrollment charter schools on any
7981 prekindergarten quality improvement efforts;
8082 (3) efforts to increase coordination between
8183 participating providers in the commission's child care program,
8284 school districts, and open-enrollment charter schools;
8385 (4) facilitation of child care provider enrollment in
8486 the Texas Rising Star Program and progression of providers to the
8587 highest rating level in the program; and
8688 (5) development and implementation of rates and
8789 payments, as determined by local workforce development boards, to:
8890 (A) allow participating providers to provide
8991 high quality child care; and
9092 (B) ensure that the commission meets performance
9193 measures established by the legislature for the average number of
9294 children served by the commission's child care program per day.
9395 (e) The commission shall make the information collected by
9496 the commission and the commission's findings available to local
9597 workforce development boards, school districts, open-enrollment
9698 charter schools, and the public.
9799 (f) Not later than January 15 of each odd-numbered year, the
98100 commission shall report to the legislature regarding the
99101 commission's findings regarding the effectiveness of the
100102 commission's child care program. The report must:
101103 (1) include employment outcome information,
102104 disaggregated by local workforce development area, regarding
103105 parents receiving subsidized care under the program; [and]
104106 (2) identify multiyear trends in the information
105107 collected and analyzed by the commission under this section,
106108 including trends in the information for at least the five state
107109 fiscal years preceding the date of the report; and
108110 (3) include information described by Sections
109111 302.0042(b)(8)-(11).
110112 SECTION 3. Section 302.00435, Labor Code, is amended to
111113 read as follows:
112114 Sec. 302.00435. SUBSIDIZED CHILD CARE PROGRAM; INPUT
113115 POLICY. (a) The commission shall develop a policy for obtaining,
114116 through appropriate methods, input from interested parties
115117 regarding its subsidized child care program and for using that
116118 input in administering that program.
117119 (b) The policy developed under Subsection (a) must include
118120 methods for obtaining input from the Texas Education Agency, school
119121 districts, open-enrollment charter schools, subsidized child care
120122 providers, relevant businesses, and the public, regarding:
121123 (1) improving coordination between the subsidized
122124 child care program and prekindergarten programs; and
123125 (2) increasing the quality of and access to the
124126 subsidized child care program.
125127 SECTION 4. This Act takes effect September 1, 2017.
