77 relating to job order contracting by governmental entities.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 2269.401, Government Code, is amended to
1010 read as follows:
1111 Sec. 2269.401. JOB ORDER CONTRACTING. In this chapter,
1212 "job order contracting" is a procurement method used for
1313 maintenance, repair, alteration, renovation, remediation, or minor
1414 new construction of a facility when the work is of a recurring
1515 nature but the delivery times, type, and quantities of work
1616 required are indefinite.
1717 SECTION 2. Section 2269.403(a), Government Code, is amended
1818 to read as follows:
1919 (a) A governmental entity may award job order contracts for
2020 the maintenance, repair, alteration, renovation, remediation, or
2121 minor new construction of a facility if:
2222 (1) the work is of a recurring nature but the delivery
2323 times are indefinite; and
2424 (2) indefinite quantities and orders are awarded
2525 substantially on the basis of predescribed and prepriced tasks.
2626 SECTION 3. Section 2269.410, Government Code, is amended by
2727 adding Subsection (c) to read as follows:
2828 (c) The price of the order under Subsection (b) may not
2929 exceed $5 million.
3030 SECTION 4. The changes in law made by this Act apply only to
3131 a job order contract entered into or renewed on or after the
3232 effective date of this Act and any order for a job or project under
3333 that contract. A job order contract entered into or renewed before
3434 the effective date of this Act and any order for a job or project
3535 under that contract is governed by the law in effect immediately
3636 before the effective date of this Act, and that law is continued in
3737 effect for that purpose.
3838 SECTION 5. This Act takes effect September 1, 2017.
