| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 2269.401, Government Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | Sec. 2269.401. JOB ORDER CONTRACTING. In this chapter, |
|---|
| 12 | 12 | | "job order contracting" is a procurement method used for |
|---|
| 13 | 13 | | maintenance, repair, alteration, renovation, remediation, or minor |
|---|
| 14 | 14 | | new construction of a facility when the work is of a recurring |
|---|
| 15 | 15 | | nature but the delivery times, type, and quantities of work |
|---|
| 16 | 16 | | required are indefinite. |
|---|
| 17 | 17 | | SECTION 2. Section 2269.403(a), Government Code, is amended |
|---|
| 18 | 18 | | to read as follows: |
|---|
| 19 | 19 | | (a) A governmental entity may award job order contracts for |
|---|
| 20 | 20 | | the maintenance, repair, alteration, renovation, remediation, or |
|---|
| 21 | 21 | | minor new construction of a facility if: |
|---|
| 22 | 22 | | (1) the work is of a recurring nature but the delivery |
|---|
| 23 | 23 | | times are indefinite; and |
|---|
| 24 | 24 | | (2) indefinite quantities and orders are awarded |
|---|
| 25 | 25 | | substantially on the basis of predescribed and prepriced tasks. |

| 26 | 26 | | SECTION 3. Section 2269.410, Government Code, is amended by |
|---|
| 27 | 27 | | adding Subsection (c) to read as follows: |
|---|
| 28 | 28 | | (c) The price of the order under Subsection (b) may not |
|---|
| 29 | 29 | | exceed $5 million. |
|---|
| 30 | 30 | | SECTION 4. The changes in law made by this Act apply only to |
|---|
| 31 | 31 | | a job order contract entered into or renewed on or after the |
|---|
| 32 | 32 | | effective date of this Act and any order for a job or project under |
|---|
| 33 | 33 | | that contract. A job order contract entered into or renewed before |
|---|
| 34 | 34 | | the effective date of this Act and any order for a job or project |
|---|
| 35 | 35 | | under that contract is governed by the law in effect immediately |
|---|
| 36 | 36 | | before the effective date of this Act, and that law is continued in |
|---|
| 37 | 37 | | effect for that purpose. |
|---|
| 38 | 38 | | SECTION 5. This Act takes effect September 1, 2017. |
