55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prosecution of the offense of improper relationship
88 between educator and student.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 21.12(a), Penal Code, is amended to read
1111 as follows:
1212 (a) An employee of a public or private primary or secondary
1313 school commits an offense if the employee:
1414 (1) engages in sexual contact, sexual intercourse, or
1515 deviate sexual intercourse with a person who is enrolled in a public
1616 or private primary or secondary school at which the employee works;
1717 (2) regardless of whether the employee holds the
1818 appropriate certificate, permit, license, or credential for the
1919 position, holds a position described by Section 21.003(a) or (b),
2020 Education Code, [a certificate or permit issued as provided by
2121 Subchapter B, Chapter 21, Education Code, or is a person who is
2222 required to be licensed by a state agency as provided by Section
2323 21.003(b), Education Code,] and engages in sexual contact, sexual
2424 intercourse, or deviate sexual intercourse with a person the
2525 employee knows is[:
2626 [(A)] enrolled in a public or private primary or
2727 secondary school, other than a school described by Subdivision (1)
2828 [in the same school district as the school at which the employee
2929 works; or
3030 [(B) a student participant in an educational
3131 activity that is sponsored by a school district or a public or
3232 private primary or secondary school, if:
3333 [(i) students enrolled in a public or
3434 private primary or secondary school are the primary participants in
3535 the activity; and
3636 [(ii) the employee provides education
3737 services to those participants]; or
3838 (3) engages in conduct described by Section 33.021,
3939 with a person described by Subdivision (1), or a person the employee
4040 knows is a person described by Subdivision (2) [(2)(A) or (B)],
4141 regardless of the age of that person.
4242 SECTION 2. The change in law made by this Act applies only
4343 to an offense committed on or after the effective date of this Act.
4444 An offense committed before the effective date of this Act is
4545 governed by the law in effect on the date the offense was committed,
4646 and the former law is continued in effect for that purpose. For
4747 purposes of this section, an offense was committed before the
4848 effective date of this Act if any element of the offense was
4949 committed before that date.
5050 SECTION 3. This Act takes effect September 1, 2017.
