 A BILL TO BE ENTITLED
 AN ACT
 relating to a restriction on the types of oil and gas wastes that
 may be disposed of in a surface pit without a permit issued by the
 Railroad Commission of Texas.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter D, Chapter 91, Natural Resources
 Code, is amended by adding Section 91.1014 to read as follows:
 Sec. 91.1014.  DISPOSAL OF CERTAIN OIL AND GAS WASTES. The
 commission may not authorize by rule the surface disposal of oil and
 gas waste without a permit if the oil and gas waste has:
 (1)  a chloride concentration of more than 3,000
 milligrams per liter;
 (2)  a total petroleum hydrocarbon concentration of
 more than 10,000 milligrams per kilogram; or
 (3)  a concentration of benzene, toluene,
 ethylbenzene, and xylene of more than 30 milligrams per kilogram.
 SECTION 2.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2017.
