10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Subchapter D, Chapter 91, Natural Resources | |
12 | 12 | Code, is amended by adding Section 91.1014 to read as follows: | |
13 | 13 | Sec. 91.1014. DISPOSAL OF CERTAIN OIL AND GAS WASTES. The | |
14 | 14 | commission may not authorize by rule the surface disposal of oil and | |
15 | 15 | gas waste without a permit if the oil and gas waste has: | |
16 | 16 | (1) a chloride concentration of more than 3,000 | |
17 | 17 | milligrams per liter; | |
18 | 18 | (2) a total petroleum hydrocarbon concentration of | |
19 | 19 | more than 10,000 milligrams per kilogram; or | |
20 | 20 | (3) a concentration of benzene, toluene, | |
21 | 21 | ethylbenzene, and xylene of more than 30 milligrams per kilogram. | |
22 | 22 | SECTION 2. This Act takes effect immediately if it receives | |
23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
26 | 26 | Act takes effect September 1, 2017. |
