66 AN ACT
77 relating to a restriction on the types of oil and gas wastes that
88 may be disposed of in a surface pit without a permit issued by the
99 Railroad Commission of Texas.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 91, Natural Resources
1212 Code, is amended by adding Section 91.1014 to read as follows:
1313 Sec. 91.1014. DISPOSAL OF CERTAIN OIL AND GAS WASTES. The
1414 commission may not authorize by rule the surface disposal of oil and
1515 gas waste without a permit if the oil and gas waste has:
1616 (1) a chloride concentration of more than 3,000
1717 milligrams per liter;
1818 (2) a total petroleum hydrocarbon concentration of
1919 more than 10,000 milligrams per kilogram; or
2020 (3) a concentration of benzene, toluene,
2121 ethylbenzene, and xylene of more than 30 milligrams per kilogram.
2222 SECTION 2. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2017.
