A BILL TO BE ENTITLED
AN ACT
relating to regulation by the Texas Transportation Commission of
the height of certain outdoor advertising.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter B, Chapter 391, Transportation Code,
is amended by adding Section 391.038 to read as follows:
Sec. 391.038. COMMISSION HEIGHT REGULATIONS PROHIBITED IN
MUNICIPALITY. The commission may not regulate the height of
outdoor advertising located in the corporate boundaries or
extraterritorial jurisdiction of a municipality.
SECTION 2. This Act takes effect September 1, 2017.
