| 7 | 7 | | identification certificate for a homeless individual. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter R, Chapter 521, Transportation Code, |
|---|
| 10 | 10 | | is amended by adding Section 521.4265 to read as follows: |
|---|
| 11 | 11 | | Sec. 521.4265. EXEMPTION FOR A HOMELESS INDIVIDUAL. (a) In |
|---|
| 12 | 12 | | this section, "homeless individual": |
|---|
| 13 | 13 | | (1) means an individual who: |
|---|
| 14 | 14 | | (A) lacks a fixed, regular, and adequate |
|---|
| 15 | 15 | | nighttime residence; or |
|---|
| 16 | 16 | | (B) has a primary nighttime residence that is: |
|---|
| 17 | 17 | | (i) a supervised publicly or privately |
|---|
| 18 | 18 | | operated shelter designed to provide temporary living |
|---|
| 19 | 19 | | accommodations, including welfare hotels, congregate shelters, and |
|---|
| 20 | 20 | | transitional housing for the mentally ill; |
|---|
| 21 | 21 | | (ii) an institution that provides a |
|---|
| 22 | 22 | | temporary residence for individuals intended to be |
|---|
| 23 | 23 | | institutionalized; or |
|---|
| 24 | 24 | | (iii) a public or private place not |
|---|
| 25 | 25 | | designed for, or ordinarily used as, a regular sleeping |
|---|
| 26 | 26 | | accommodation for human beings; and |
|---|
| 27 | 27 | | (2) does not include an individual who is imprisoned |
|---|
| 28 | 28 | | or otherwise detained in a correctional facility. |
|---|
| 29 | 29 | | (b) Except as provided by Subsections (f) and (g), a |
|---|
| 30 | 30 | | homeless individual is entitled to an exemption from the payment of |
|---|
| 31 | 31 | | fees under this chapter for the issuance of a driver's license or |
|---|
| 32 | 32 | | personal identification certificate. |
|---|
| 33 | 33 | | (c) For the purposes of this section, to confirm a person's |
|---|
| 34 | 34 | | status as a homeless individual he or she must submit a notarized |
|---|
| 35 | 35 | | affidavit from: |
|---|
| 36 | 36 | | (1) an employee of a homeless shelter or transitional |
|---|
| 37 | 37 | | housing facility; |
|---|
| 38 | 38 | | (2) an employee of an organization that provides to |
|---|
| 39 | 39 | | homeless individuals or assists homeless individuals in obtaining |
|---|
| 40 | 40 | | services such as health services, mental or behavioral health |
|---|
| 41 | 41 | | services, substance abuse services, public assistance services, or |
|---|
| 42 | 42 | | employment services; |
|---|
| 43 | 43 | | (3) an attorney licensed to practice law in this |
|---|
| 44 | 44 | | state; |
|---|
| 45 | 45 | | (4) a peace officer who is an official homeless |
|---|
| 46 | 46 | | liaison; or |
|---|
| 47 | 47 | | (5) an employee of a faith-based organization that |
|---|
| 48 | 48 | | provides benefits or services to homeless individuals. |
|---|
| 49 | 49 | | (d) A person may not charge a fee for the affidavit |
|---|
| 50 | 50 | | described by Subsection (c). |
|---|
| 51 | 51 | | (e) An affidavit described by Subsection (c) may not be used |
|---|
| 52 | 52 | | for a driver's license or personal identification certificate |
|---|
| 53 | 53 | | application if the affidavit was signed more than 60 days before the |
|---|
| 54 | 54 | | date the application is submitted. |
|---|
| 55 | 55 | | (f) Subsection (b) does not apply to a person subject to the |
|---|
| 56 | 56 | | registration requirements of Chapter 62, Code of Criminal |
|---|
| 57 | 57 | | Procedure. |
|---|
| 58 | 58 | | (g) For each exemption granted under this section the |
|---|
| 59 | 59 | | department shall deposit to the credit of the Texas mobility fund an |
|---|
| 60 | 60 | | amount from the identification fee exemption account under |
|---|
| 61 | 61 | | Subsection (h) that is equal to the amount of the waived fee that |
|---|
| 62 | 62 | | would otherwise be deposited to the mobility fund. |
|---|
| 63 | 63 | | (h) The identification fee exemption account is created as |
|---|
| 64 | 64 | | an account in the general revenue fund of the state treasury. The |
|---|
| 65 | 65 | | fund consists of grants and donations made to the department for the |
|---|
| 66 | 66 | | purposes of this section. The department shall administer the |
|---|
| 67 | 67 | | account. Money in the account may be appropriated for the purposes |
|---|
| 68 | 68 | | of Subsection (g). |
|---|
| 69 | 69 | | (i) The department may not grant an exemption under this |
|---|
| 70 | 70 | | section if money is not available in the identification fee |
|---|
| 71 | 71 | | exemption account to meet the requirements of Subsection (g). |
|---|
| 72 | 72 | | SECTION 2. This Act takes effect September 1, 2017. |
