55 AN ACT
66 relating to the fee for a driver's license or personal
77 identification certificate for a homeless individual.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter R, Chapter 521, Transportation Code,
1010 is amended by adding Section 521.4265 to read as follows:
1111 Sec. 521.4265. EXEMPTION FOR A HOMELESS INDIVIDUAL. (a) In
1212 this section, "homeless individual":
1313 (1) means an individual who:
1414 (A) lacks a fixed, regular, and adequate
1515 nighttime residence; or
1616 (B) has a primary nighttime residence that is:
1717 (i) a supervised publicly or privately
1818 operated shelter designed to provide temporary living
1919 accommodations, including welfare hotels, congregate shelters, and
2020 transitional housing for the mentally ill;
2121 (ii) an institution that provides a
2222 temporary residence for individuals intended to be
2323 institutionalized; or
2424 (iii) a public or private place not
2525 designed for, or ordinarily used as, a regular sleeping
2626 accommodation for human beings; and
2727 (2) does not include an individual who is imprisoned
2828 or otherwise detained in a correctional facility.
2929 (b) Except as provided by Subsections (f) and (g), a
3030 homeless individual is entitled to an exemption from the payment of
3131 fees under this chapter for the issuance of a driver's license or
3232 personal identification certificate.
3333 (c) For the purposes of this section, to confirm a person's
3434 status as a homeless individual he or she must submit a notarized
3535 affidavit from:
3636 (1) an employee of a homeless shelter or transitional
3737 housing facility;
3838 (2) an employee of an organization that provides to
3939 homeless individuals or assists homeless individuals in obtaining
4040 services such as health services, mental or behavioral health
4141 services, substance abuse services, public assistance services, or
4242 employment services;
4343 (3) an attorney licensed to practice law in this
4444 state;
4545 (4) a peace officer who is an official homeless
4646 liaison; or
4747 (5) an employee of a faith-based organization that
4848 provides benefits or services to homeless individuals.
4949 (d) A person may not charge a fee for the affidavit
5050 described by Subsection (c).
5151 (e) An affidavit described by Subsection (c) may not be used
5252 for a driver's license or personal identification certificate
5353 application if the affidavit was signed more than 60 days before the
5454 date the application is submitted.
5555 (f) Subsection (b) does not apply to a person subject to the
5656 registration requirements of Chapter 62, Code of Criminal
5757 Procedure.
5858 (g) For each exemption granted under this section the
5959 department shall deposit to the credit of the Texas mobility fund an
6060 amount from the identification fee exemption account under
6161 Subsection (h) that is equal to the amount of the waived fee that
6262 would otherwise be deposited to the mobility fund.
6363 (h) The identification fee exemption account is created as
6464 an account in the general revenue fund of the state treasury. The
6565 fund consists of grants and donations made to the department for the
6666 purposes of this section. The department shall administer the
6767 account. Money in the account may be appropriated for the purposes
6868 of Subsection (g).
6969 (i) The department may not grant an exemption under this
7070 section if money is not available in the identification fee
7171 exemption account to meet the requirements of Subsection (g).
7272 SECTION 2. This Act takes effect September 1, 2017.
