66 AN ACT
77 relating to the eligibility of certain metropolitan rapid transit
88 authorities to receive funding from certain settlements.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 451, Transportation Code,
1111 is amended by adding Section 451.114 to read as follows:
1212 Sec. 451.114. SETTLEMENT ELIGIBILITY. (a) This section
1313 applies only to a consent decree filed in the United States District
1414 Court, Northern District of California, in the case styled In re:
1515 Volkswagen "Clean Diesel" Marketing, Sales Practices, And Products
1616 Liability Litigation, Case No. MDL No. 2672 CRB.
1717 (b) An authority created before 1980 and in which the
1818 principal municipality has a population of less than 1.9 million is
1919 eligible to receive funding allocated to this state from an
2020 environmental mitigation trust established under the terms of a
2121 consent decree for eligible mitigation actions.
2222 SECTION 2. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2017.
