9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter C, Chapter 451, Transportation Code, |
---|
11 | 11 | | is amended by adding Section 451.114 to read as follows: |

12 | 12 | | Sec. 451.114. SETTLEMENT ELIGIBILITY. (a) This section |
---|
13 | 13 | | applies only to a consent decree filed in the United States District |
---|
14 | 14 | | Court, Northern District of California, in the case styled In re: |
---|
15 | 15 | | Volkswagen "Clean Diesel" Marketing, Sales Practices, And Products |
---|
16 | 16 | | Liability Litigation, Case No. MDL No. 2672 CRB. |
---|
17 | 17 | | (b) An authority created before 1980 and in which the |
---|
18 | 18 | | principal municipality has a population of less than 1.9 million is |
---|
19 | 19 | | eligible to receive funding allocated to this state from an |
---|
20 | 20 | | environmental mitigation trust established under the terms of a |
---|
21 | 21 | | consent decree for eligible mitigation actions. |
---|
22 | 22 | | SECTION 2. This Act takes effect immediately if it receives |
---|
23 | 23 | | a vote of two-thirds of all the members elected to each house, as |
---|
24 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
25 | 25 | | Act does not receive the vote necessary for immediate effect, this |
---|
26 | 26 | | Act takes effect September 1, 2017. |
