55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the statewide plan for special education and assistance
88 to public school districts in providing special education programs.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 8.051(d), Education Code, is amended to
1111 read as follows:
1212 (d) Each regional education service center shall maintain
1313 core services for purchase by school districts and campuses. The
1414 core services are:
1515 (1) training and assistance in:
1616 (A) teaching each subject area assessed under
1717 Section 39.023; and
1818 (B) providing instruction in personal financial
1919 literacy as required under Section 28.0021;
2020 (2) training and assistance in providing each program
2121 that qualifies for a funding allotment under Section 42.151,
2222 42.152, 42.153, or 42.156;
2323 (3) assistance specifically designed for a school
2424 district or campus assigned an unacceptable performance rating
2525 under Section 39.054;
2626 (4) training and assistance to teachers,
2727 administrators, members of district boards of trustees, and members
2828 of site-based decision-making committees;
2929 (5) assistance specifically designed for a school
3030 district that is considered:
3131 (A) out of compliance with state or federal
3232 special education requirements, based on the agency's most recent
3333 compliance review of the district's special education programs; or
3434 (B) in need of intervention or substantial
3535 intervention based on the agency's most recent determination
3636 regarding the district's special education programs under 34 C.F.R.
3737 Section 300.600(a)(2); and
3838 (6) assistance in complying with state laws and rules.
3939 SECTION 2. Section 29.001, Education Code, is amended to
4040 read as follows:
4141 Sec. 29.001. STATEWIDE PLAN. The agency shall develop, and
4242 modify as necessary, a statewide design, consistent with federal
4343 law, for the delivery of services to children with disabilities in
4444 this state that includes rules for the administration and funding
4545 of the special education program so that a free appropriate public
4646 education is available to all of those children between the ages of
4747 three and 21. The statewide design shall include the provision of
4848 services primarily through school districts and shared services
4949 arrangements, supplemented by regional education service centers.
5050 The agency shall also develop and implement a statewide plan with
5151 programmatic content that includes procedures designed to:
5252 (1) ensure state compliance with requirements for
5353 supplemental federal funding for all state-administered programs
5454 involving the delivery of instructional or related services to
5555 students with disabilities;
5656 (2) facilitate interagency coordination when other
5757 state agencies are involved in the delivery of instructional or
5858 related services to students with disabilities;
5959 (3) periodically assess statewide personnel needs in
6060 all areas of specialization related to special education and pursue
6161 strategies to meet those needs through a consortium of
6262 representatives from regional education service centers, local
6363 education agencies, [and] institutions of higher education, the
6464 Texas Higher Education Coordinating Board, and the State Board for
6565 Educator Certification and through other available alternatives;
6666 (4) ensure that regional education service centers
6767 throughout the state maintain a regional support function, which
6868 may include direct service delivery and a component designed to
6969 facilitate the placement of students with disabilities who cannot
7070 be appropriately served in their resident districts;
7171 (5) allow the agency to effectively monitor and
7272 periodically conduct site visits of all school districts to ensure
7373 that rules adopted under this section are applied in a consistent
7474 and uniform manner, to ensure that districts are complying with
7575 those rules, and to ensure that annual statistical reports filed by
7676 the districts and not otherwise available through the Public
7777 Education Information Management System under Section 42.006 are
7878 accurate and complete;
7979 (6) ensure that [appropriately trained] personnel
8080 [are] involved in the diagnostic and evaluative procedures
8181 operating in all districts:
8282 (A) are appropriately trained, including
8383 training in linguistic and culturally appropriate evaluations;
8484 (B) have appropriate assessment instruments
8585 available, including assessment instruments in languages other
8686 than English to the extent possible; and
8787 (C) [that those personnel] routinely serve on
8888 district admissions, review, and dismissal committees;
8989 (7) ensure that an individualized education program
9090 for each student with a disability is properly developed,
9191 implemented, and maintained in the least restrictive environment
9292 that is appropriate to meet the student's educational needs;
9393 (8) ensure that, when appropriate, each student with a
9494 disability is provided an opportunity to participate in career and
9595 technology and physical education classes, in addition to
9696 participating in regular or special classes;
9797 (9) ensure that each student with a disability is
9898 provided necessary related services;
9999 (10) ensure that an individual assigned to act as a
100100 surrogate parent for a child with a disability, as provided by 20
101101 U.S.C. Section 1415(b), is required to:
102102 (A) complete a training program that complies
103103 with minimum standards established by agency rule;
104104 (B) visit the child and the child's school;
105105 (C) consult with persons involved in the child's
106106 education, including teachers, caseworkers, court-appointed
107107 volunteers, guardians ad litem, attorneys ad litem, foster parents,
108108 and caretakers;
109109 (D) review the child's educational records;
110110 (E) attend meetings of the child's admission,
111111 review, and dismissal committee;
112112 (F) exercise independent judgment in pursuing
113113 the child's interests; and
114114 (G) exercise the child's due process rights under
115115 applicable state and federal law; and
116116 (11) ensure that each district develops a process to
117117 be used by a teacher who instructs a student with a disability in a
118118 regular classroom setting:
119119 (A) to request a review of the student's
120120 individualized education program;
121121 (B) to provide input in the development of the
122122 student's individualized education program;
123123 (C) that provides for a timely district response
124124 to the teacher's request; and
125125 (D) that provides for notification to the
126126 student's parent or legal guardian of that response.
127127 SECTION 3. This Act applies beginning with the 2017-2018
128128 school year.
129129 SECTION 4. This Act takes effect immediately if it receives
130130 a vote of two-thirds of all the members elected to each house, as
131131 provided by Section 39, Article III, Texas Constitution. If this
132132 Act does not receive the vote necessary for immediate effect, this
133133 Act takes effect September 1, 2017.
