66 AN ACT
77 relating to an application for a ballot to be voted by mail.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 86.0015(b) and (b-2), Election Code,
1010 are amended to read as follows:
1111 (b) An application described by Subsection (a) is
1212 considered to be an application for a ballot for each election,
1313 including any ensuing runoff:
1414 (1) in which the applicant is eligible to vote; and
1515 (2) that occurs before the earlier of:
1616 (A) except as provided by Subsection (b-2),
1717 January 1 of the first odd-numbered year after [end of] the calendar
1818 year in which the application was submitted;
1919 (B) the date the county clerk receives notice
2020 from the voter registrar under Subsection (f) that the voter has
2121 changed residence to another county; or
2222 (C) the date the voter's registration is
2323 canceled.
2424 (b-2) An application is considered to be submitted in the
2525 following calendar year for purposes of this section if:
2626 (1) the applicant is eligible to vote in an election
2727 occurring in January or February of the next calendar year; and
2828 (2) the application is submitted in the last 60 days of
2929 an even-numbered [a] calendar year but not earlier than the 60th day
3030 before the date of the January or February election.
3131 SECTION 2. The change in law made by this Act applies only
3232 to an application for a ballot to be voted by mail received on or
3333 after January 1, 2017.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2017.
