55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the time period for the withdrawal of a candidate for a
88 general primary election.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 172.052(a), Election Code, is amended to
1111 read as follows:
1212 (a) A candidate for nomination may not withdraw from the
1313 general primary election after the third [first] day after the date
1414 of the regular filing deadline for the general primary election.
1515 SECTION 2. Section 172.054(a), Election Code, is amended to
1616 read as follows:
1717 (a) The deadline for filing an application for a place on
1818 the general primary election ballot is extended as provided by this
1919 section if a candidate who has made an application that complies
2020 with the applicable requirements:
2121 (1) dies on or after the fifth day before the date of
2222 the regular filing deadline and on or before the first day after the
2323 date of the regular filing deadline;
2424 (2) holds the office for which the application was
2525 made and:
2626 (A) withdraws on or before the third day after
2727 the date of the regular filing deadline; or
2828 (B) is declared ineligible on the date of the
2929 regular filing deadline or the first day after the date of the
3030 regular filing deadline; or
3131 (3) withdraws or is declared ineligible during the
3232 period prescribed by Subdivision (2)(A) or (B), as applicable
3333 [(2)], and at the time of the withdrawal or declaration of
3434 ineligibility no other candidate has made an application that
3535 complies with the applicable requirements for the office sought by
3636 the withdrawn or ineligible candidate.
3737 SECTION 3. Section 172.057, Election Code, is amended to
3838 read as follows:
3939 Sec. 172.057. WITHDRAWN, DECEASED, OR INELIGIBLE
4040 CANDIDATE'S NAME OMITTED FROM GENERAL PRIMARY BALLOT. A
4141 candidate's name shall be omitted from the general primary election
4242 ballot if the candidate [withdraws,] dies[,] or is declared
4343 ineligible on or before the first day after the date of the regular
4444 filing deadline or withdraws on or before the third day after the
4545 date of the regular filing deadline.
4646 SECTION 4. This Act takes effect immediately if it receives
4747 a vote of two-thirds of all the members elected to each house, as
4848 provided by Section 39, Article III, Texas Constitution. If this
4949 Act does not receive the vote necessary for immediate effect, this
5050 Act takes effect September 1, 2017.
