55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the exemption from range instruction for certain
88 persons applying to obtain a license to carry a handgun.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 411.1881(a), Government Code, is amended
1111 to read as follows:
1212 (a) Notwithstanding any other provision of this subchapter,
1313 a person may not be required to complete the range instruction
1414 portion of a handgun proficiency course to obtain a license issued
1515 under this subchapter if the person:
1616 (1) is currently serving in or is honorably discharged
1717 from:
1818 (A) the army, navy, air force, coast guard, or
1919 marine corps of the United States or an auxiliary service or reserve
2020 unit of one of those branches of the armed forces; or
2121 (B) the Texas military forces, as defined by
2222 Section 437.001; and
2323 (2) has, within the 10 [five] years preceding the date
2424 of the person's application for the license, completed as part of
2525 the person's service with the armed forces or Texas military
2626 forces:
2727 (A) a course of training in firearm [handgun]
2828 proficiency or familiarization; or
2929 (B) a range qualification process for firearm
3030 usage [as part of the person's service with the armed forces or
3131 Texas military forces].
3232 SECTION 2. Not later than December 1, 2017, the director of
3333 the Department of Public Safety shall adopt the forms and
3434 procedures required by Section 411.1881, Government Code, as
3535 amended by this Act.
3636 SECTION 3. The change in law made by this Act applies only
3737 to an application to obtain a license to carry a handgun submitted
3838 on or after December 1, 2017. An application submitted before
3939 December 1, 2017, is governed by the law in effect on the date the
4040 application was submitted, and the former law is continued in
4141 effect for that purpose.
4242 SECTION 4. This Act takes effect September 1, 2017.
