| 7 | 7 | | relating to the exemption from range instruction for certain |
|---|
| 8 | 8 | | persons applying to obtain a license to carry a handgun. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Section 411.1881(a), Government Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (a) Notwithstanding any other provision of this subchapter, |
|---|
| 13 | 13 | | a person may not be required to complete the range instruction |
|---|
| 14 | 14 | | portion of a handgun proficiency course to obtain a license issued |
|---|
| 15 | 15 | | under this subchapter if the person: |
|---|
| 16 | 16 | | (1) is currently serving in or is honorably discharged |
|---|
| 17 | 17 | | from: |
|---|
| 18 | 18 | | (A) the army, navy, air force, coast guard, or |
|---|
| 19 | 19 | | marine corps of the United States or an auxiliary service or reserve |
|---|
| 20 | 20 | | unit of one of those branches of the armed forces; or |
|---|
| 21 | 21 | | (B) the Texas military forces, as defined by |
|---|
| 22 | 22 | | Section 437.001; and |
|---|
| 23 | 23 | | (2) has, within the 10 [five] years preceding the date |
|---|
| 24 | 24 | | of the person's application for the license, completed as part of |
|---|
| 25 | 25 | | the person's service with the armed forces or Texas military |
|---|
| 26 | 26 | | forces: |
|---|
| 27 | 27 | | (A) a course of training in firearm [handgun] |
|---|
| 28 | 28 | | proficiency or familiarization; or |
|---|
| 29 | 29 | | (B) a range qualification process for firearm |
|---|
| 30 | 30 | | usage [as part of the person's service with the armed forces or |
|---|
| 31 | 31 | | Texas military forces]. |
|---|
| 32 | 32 | | SECTION 2. Not later than December 1, 2017, the director of |
|---|
| 33 | 33 | | the Department of Public Safety shall adopt the forms and |
|---|
| 34 | 34 | | procedures required by Section 411.1881, Government Code, as |
|---|
| 35 | 35 | | amended by this Act. |
|---|
| 36 | 36 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 37 | 37 | | to an application to obtain a license to carry a handgun submitted |
|---|
| 38 | 38 | | on or after December 1, 2017. An application submitted before |
|---|
| 39 | 39 | | December 1, 2017, is governed by the law in effect on the date the |
|---|
| 40 | 40 | | application was submitted, and the former law is continued in |
|---|
| 41 | 41 | | effect for that purpose. |
|---|
| 42 | 42 | | SECTION 4. This Act takes effect September 1, 2017. |
