| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 74.09(a), Alcoholic Beverage Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) In addition to the activities authorized by Section |
|---|
| 13 | 13 | | 74.01, the holder of a brewpub license may sell beer produced under |
|---|
| 14 | 14 | | the license to the holder of a general, local, or branch |
|---|
| 15 | 15 | | distributor's license or to qualified distributors or other |
|---|
| 16 | 16 | | similarly situated entities outside the state. |

| 17 | 17 | | SECTION 2. Section 74.10(a), Alcoholic Beverage Code, is |
|---|
| 18 | 18 | | amended to read as follows: |
|---|
| 19 | 19 | | (a) In addition to the activities authorized by Section |
|---|
| 20 | 20 | | 74.01, the holder of a brewpub license may sell ale and malt liquor |
|---|
| 21 | 21 | | to the holder of a wholesaler's permit, a general class B |
|---|
| 22 | 22 | | wholesaler's permit, or a local class B wholesaler's permit or to |
|---|
| 23 | 23 | | qualified wholesalers or other similarly situated entities outside |
|---|
| 24 | 24 | | the state. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2017. |
