44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the Texas natural gas vehicle grant program, including
77 the funding of fueling stations from grants under that program.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 394.010, Health and Safety Code, is
1010 amended by amending Subsection (d) and adding Subsection (d-1) to
1111 read as follows:
1212 (d) A station [Stations] funded by a grant [grants] under
1313 this section must be publicly accessible unless the station is:
1414 (1) owned or operated by a transit authority governed
1515 by Chapter 451 or 452, Transportation Code; and
1616 (2) located in a county that has a population of more
1717 than one million.
1818 (d-1) The commission shall give preference to:
1919 (1) stations providing both liquefied natural gas and
2020 compressed natural gas at a single location;
2121 (2) stations located not more than one mile from an
2222 interstate highway system; and
2323 (3) stations located in the triangular area between
2424 the Houston, San Antonio, and Dallas-Fort Worth areas.
2525 SECTION 2. Section 394.012, Health and Safety Code, is
2626 amended to read as follows:
2727 Sec. 394.012. EXPIRATION. This chapter expires on the last
2828 day of the state fiscal biennium during which the commission
2929 publishes in the Texas Register certification that, with respect to
3030 each national ambient air quality standard for ozone under 40
3131 C.F.R. Section 81.344, the United States Environmental Protection
3232 Agency has, for each designated area under that section:
3333 (1) designated the area as attainment or
3434 unclassifiable; or
3535 (2) approved a redesignation substitute making a
3636 finding of attainment for the area [August 31, 2017].
3737 SECTION 3. This Act takes effect August 30, 2017.
