| 6 | 6 | | relating to the Texas natural gas vehicle grant program, including |

| 7 | 7 | | the funding of fueling stations from grants under that program. |
|---|
| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 394.010, Health and Safety Code, is |
|---|
| 10 | 10 | | amended by amending Subsection (d) and adding Subsection (d-1) to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (d) A station [Stations] funded by a grant [grants] under |
|---|
| 13 | 13 | | this section must be publicly accessible unless the station is: |
|---|
| 14 | 14 | | (1) owned or operated by a transit authority governed |
|---|
| 15 | 15 | | by Chapter 451 or 452, Transportation Code; and |
|---|
| 16 | 16 | | (2) located in a county that has a population of more |
|---|
| 17 | 17 | | than one million. |
|---|
| 18 | 18 | | (d-1) The commission shall give preference to: |
|---|
| 19 | 19 | | (1) stations providing both liquefied natural gas and |
|---|
| 20 | 20 | | compressed natural gas at a single location; |
|---|
| 21 | 21 | | (2) stations located not more than one mile from an |
|---|
| 22 | 22 | | interstate highway system; and |
|---|
| 23 | 23 | | (3) stations located in the triangular area between |
|---|
| 24 | 24 | | the Houston, San Antonio, and Dallas-Fort Worth areas. |

| 25 | 25 | | SECTION 2. Section 394.012, Health and Safety Code, is |
|---|
| 26 | 26 | | amended to read as follows: |
|---|
| 27 | 27 | | Sec. 394.012. EXPIRATION. This chapter expires on the last |
|---|
| 28 | 28 | | day of the state fiscal biennium during which the commission |
|---|
| 29 | 29 | | publishes in the Texas Register certification that, with respect to |
|---|
| 30 | 30 | | each national ambient air quality standard for ozone under 40 |
|---|
| 31 | 31 | | C.F.R. Section 81.344, the United States Environmental Protection |
|---|
| 32 | 32 | | Agency has, for each designated area under that section: |
|---|
| 33 | 33 | | (1) designated the area as attainment or |
|---|
| 34 | 34 | | unclassifiable; or |
|---|
| 35 | 35 | | (2) approved a redesignation substitute making a |
|---|
| 36 | 36 | | finding of attainment for the area [August 31, 2017]. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect August 30, 2017. |
