| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Article 42A.558, Code of Criminal Procedure, is |
|---|
| 11 | 11 | | amended by adding Subsection (b-1) to read as follows: |
|---|
| 12 | 12 | | (b-1) Not later than the 60th day after the date a defendant |
|---|
| 13 | 13 | | is received into the custody of a state jail felony facility, the |
|---|
| 14 | 14 | | Texas Department of Criminal Justice shall notify the sentencing |
|---|
| 15 | 15 | | court of the date on which the defendant will have served 75 days in |
|---|
| 16 | 16 | | the facility. The notice must be provided by e-mail or other |
|---|
| 17 | 17 | | electronic communication. |
|---|
| 18 | 18 | | SECTION 2. The change in law made by this Act to Article |
|---|
| 19 | 19 | | 42A.558, Code of Criminal Procedure, applies only to a defendant |
|---|
| 20 | 20 | | who receives a sentence of confinement in a state jail on or after |
|---|
| 21 | 21 | | the effective date of this Act. A defendant who receives a sentence |
|---|
| 22 | 22 | | of confinement in a state jail before the effective date of this Act |
|---|
| 23 | 23 | | is governed by the law in effect at the time of sentencing, and the |
|---|
| 24 | 24 | | former law is continued in effect for that purpose. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect September 1, 2017. |
