66 AN ACT
77 relating to the designation of the San Angelo State Supported
88 Living Center as a forensic state supported living center.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 555.002, Health and
1111 Safety Code, is amended to read as follows:
1212 Sec. 555.002. FORENSIC STATE SUPPORTED LIVING CENTERS
1313 [CENTER].
1414 SECTION 2. Sections 555.002(a), (b), (c), and (d), Health
1515 and Safety Code, are amended to read as follows:
1616 (a) The department shall designate [establish a] separate
1717 forensic state supported living centers [center] for the care
1818 [apart from other clients and residents] of high-risk alleged
1919 offender residents. The department shall designate the Mexia and
2020 San Angelo State Supported Living Centers [Center] for this
2121 purpose.
2222 (b) In establishing the forensic state supported living
2323 centers [center], the department shall:
2424 (1) transfer an alleged offender resident already
2525 residing in a center who is classified as a high-risk alleged
2626 offender resident in accordance with Section 555.003, to a [the]
2727 forensic state supported living center;
2828 (2) place high-risk alleged offender residents in
2929 appropriate [separate] homes at a [the] forensic state supported
3030 living center based on whether an individual is:
3131 (A) an adult or a person younger than 18 years of
3232 age; or
3333 (B) male or female;
3434 (3) place alleged offender residents who are charged
3535 with or convicted of a felony offense or who are alleged by petition
3636 or have been found to have engaged in delinquent conduct defined as
3737 a felony offense, at the time the residents are initially committed
3838 to or transferred to a center, in a [the] forensic state supported
3939 living center until a determination under Section 555.003 has been
4040 completed;
4141 (4) transfer all residents who request a transfer,
4242 other than high-risk alleged offender residents and alleged
4343 offender residents described by Subdivision (3) and for whom a
4444 determination has not been completed under Section 555.003, from a
4545 [the] forensic state supported living center; and
4646 (5) provide training regarding the service delivery
4747 system for high-risk alleged offender residents to direct care
4848 employees of a [the] forensic state supported living center.
4949 (c) An alleged offender resident committed to a [the]
5050 forensic state supported living center, for whom a determination
5151 under Section 555.003 has been completed and who is not classified
5252 as a high-risk alleged offender resident, may request a transfer to
5353 another center in accordance with Subchapter B, Chapter 594.
5454 (d) The department shall ensure that each [the] forensic
5555 state supported living center:
5656 (1) complies with the requirements for ICF-IID
5757 certification under the Medicaid program, as appropriate; and
5858 (2) has a sufficient number of [additional] center
5959 employees, including direct care employees, to protect the safety
6060 of center employees, residents, and the community.
6161 SECTION 3. Section 29.452, Education Code, is amended to
6262 read as follows:
6363 Sec. 29.452. APPLICABILITY. This subchapter applies only
6464 to an alleged offender resident of a [the] forensic state supported
6565 living center designated [established] under Section 555.002,
6666 Health and Safety Code.
6767 SECTION 4. This Act takes effect September 1, 2017.
