| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 372.101, Transportation Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | Sec. 372.101. APPLICABILITY. Except as provided by Section |
|---|
| 13 | 13 | | 372.115(b), this [This] subchapter does not apply to a county |
|---|
| 14 | 14 | | acting under Chapter 284. |
|---|
| 15 | 15 | | SECTION 2. Section 372.115, Transportation Code, is amended |

| 16 | 16 | | to read as follows: |

| 17 | 17 | | Sec. 372.115. USE OF REMEDIES OPTIONAL; EXCEPTION FOR |

| 18 | 18 | | CERTAIN COUNTY TOLL AUTHORITIES. (a) A toll project entity's use |

| 19 | 19 | | of remedies under this subchapter is cumulative of other remedies |
|---|
| 20 | 20 | | and, except as provided by Subsection (b), is optional. Nothing[, |
|---|
| 21 | 21 | | and nothing] in this subchapter prohibits a toll project entity |
|---|
| 22 | 22 | | from exercising any other enforcement remedies available under this |
|---|
| 23 | 23 | | chapter or other law. |
|---|
| 24 | 24 | | (b) A county acting under Chapter 284 that participates in a |
|---|
| 25 | 25 | | regional tollway authority under Chapter 366 shall pursue the |
|---|
| 26 | 26 | | habitual violator remedies under this subchapter. |

| 27 | 27 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2017. |
