77 relating to the use of habitual toll violator remedies by certain
88 toll project entities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 372.101, Transportation Code, is amended
1111 to read as follows:
1212 Sec. 372.101. APPLICABILITY. Except as provided by Section
1313 372.115(b), this [This] subchapter does not apply to a county
1414 acting under Chapter 284.
1515 SECTION 2. Section 372.115, Transportation Code, is amended
1616 to read as follows:
1717 Sec. 372.115. USE OF REMEDIES OPTIONAL; EXCEPTION FOR
1818 CERTAIN COUNTY TOLL AUTHORITIES. (a) A toll project entity's use
1919 of remedies under this subchapter is cumulative of other remedies
2020 and, except as provided by Subsection (b), is optional. Nothing[,
2121 and nothing] in this subchapter prohibits a toll project entity
2222 from exercising any other enforcement remedies available under this
2323 chapter or other law.
2424 (b) A county acting under Chapter 284 that participates in a
2525 regional tollway authority under Chapter 366 shall pursue the
2626 habitual violator remedies under this subchapter.
2727 SECTION 3. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2017.
