66 AN ACT
77 relating to compensation to a property owner for property acquired
88 by an entity with eminent domain authority.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 21.041, Property Code, is amended to
1111 read as follows:
1212 Sec. 21.041. EVIDENCE. (a) As the basis for assessing
1313 actual damages to a property owner from a condemnation, the special
1414 commissioners shall admit evidence on:
1515 (1) the value of the property being condemned;
1616 (2) the injury to the property owner;
1717 (3) the benefit to the property owner's remaining
1818 property; and
1919 (4) the use of the property for the purpose of the
2020 condemnation.
2121 (b) The special commissioners may admit evidence on the
2222 price paid for pipeline or power line rights-of-way in privately
2323 negotiated transactions made in the absence of a potential, actual,
2424 or threatened condemnation.
2525 SECTION 2. Section 21.041, Property Code, as amended by
2626 this Act, applies only to an eminent domain proceeding commenced on
2727 or after the effective date of this Act. An eminent domain
2828 proceeding commenced before the effective date of this Act is
2929 governed by the law applicable to the proceeding immediately before
3030 the effective date of this Act, and that law is continued in effect
3131 for that purpose.
3232 SECTION 3. This Act takes effect September 1, 2017.
