| 7 | 7 | | relating to compensation to a property owner for property acquired |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 21.041, Property Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | Sec. 21.041. EVIDENCE. (a) As the basis for assessing |
|---|
| 13 | 13 | | actual damages to a property owner from a condemnation, the special |
|---|
| 14 | 14 | | commissioners shall admit evidence on: |
|---|
| 15 | 15 | | (1) the value of the property being condemned; |
|---|
| 16 | 16 | | (2) the injury to the property owner; |
|---|
| 17 | 17 | | (3) the benefit to the property owner's remaining |
|---|
| 18 | 18 | | property; and |
|---|
| 19 | 19 | | (4) the use of the property for the purpose of the |
|---|
| 20 | 20 | | condemnation. |
|---|
| 21 | 21 | | (b) The special commissioners may admit evidence on the |
|---|
| 22 | 22 | | price paid for pipeline or power line rights-of-way in privately |
|---|
| 23 | 23 | | negotiated transactions made in the absence of a potential, actual, |
|---|
| 24 | 24 | | or threatened condemnation. |
|---|
| 25 | 25 | | SECTION 2. Section 21.041, Property Code, as amended by |
|---|
| 26 | 26 | | this Act, applies only to an eminent domain proceeding commenced on |
|---|
| 27 | 27 | | or after the effective date of this Act. An eminent domain |
|---|
| 28 | 28 | | proceeding commenced before the effective date of this Act is |
|---|
| 29 | 29 | | governed by the law applicable to the proceeding immediately before |
|---|
| 30 | 30 | | the effective date of this Act, and that law is continued in effect |
|---|
| 31 | 31 | | for that purpose. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2017. |
