| 7 | 7 | | relating to the establishment of a pilot program to provide |

| 8 | 8 | | services to certain persons with Alzheimer's disease and related |
|---|
| 9 | 9 | | dementia enrolled in the Medicaid managed care program. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter B, Chapter 531, Government Code, is |
|---|
| 12 | 12 | | amended by adding Section 531.09972 to read as follows: |
|---|
| 13 | 13 | | Sec. 531.09972. PILOT PROGRAM FOR CERTAIN PERSONS WITH |
|---|
| 14 | 14 | | ALZHEIMER'S DISEASE AND RELATED DEMENTIA. (a) The commission |
|---|
| 15 | 15 | | shall develop and implement a pilot program to improve the quality |
|---|
| 16 | 16 | | of life and prevent the premature institutionalization of persons |
|---|
| 17 | 17 | | with Alzheimer's disease and related dementia who receive services |
|---|
| 18 | 18 | | from a day activity and health services facility licensed under |
|---|
| 19 | 19 | | Chapter 103, Human Resources Code, and who are recipients of |
|---|
| 20 | 20 | | Medicaid through a Medicaid managed care model or arrangement under |
|---|
| 21 | 21 | | Chapter 533. |
|---|
| 22 | 22 | | (b) In developing the pilot program, the commission shall |
|---|
| 23 | 23 | | solicit input from relevant stakeholders, including caregivers, |
|---|
| 24 | 24 | | advocates, Medicaid managed care organizations, providers, |
|---|
| 25 | 25 | | physicians specializing in dementia, and social workers. |
|---|
| 26 | 26 | | (c) The executive commissioner shall adopt rules for the |
|---|
| 27 | 27 | | implementation of the pilot program, including life safety, |
|---|
| 28 | 28 | | staffing, training, and programming requirements for the pilot |
|---|
| 29 | 29 | | program necessary to ensure that the specific needs of the pilot |
|---|
| 30 | 30 | | program participants are met. |
|---|
| 31 | 31 | | (d) The pilot program must be based on evidence-based, |
|---|
| 32 | 32 | | person-centered practices and ensure quality of care outcomes, |
|---|
| 33 | 33 | | including outcomes based on safety, effectiveness, efficiency, and |
|---|
| 34 | 34 | | equity, for the pilot program participants. |
|---|
| 35 | 35 | | (e) Not later than December 1, 2018, the commission shall |
|---|
| 36 | 36 | | report to the legislature on the progress of the pilot program. |
|---|
| 37 | 37 | | This subsection expires September 1, 2019. |
|---|
| 38 | 38 | | SECTION 2. If before implementing any provision of this Act |
|---|
| 39 | 39 | | a state agency determines that a waiver or authorization from a |
|---|
| 40 | 40 | | federal agency is necessary for implementation of that provision, |
|---|
| 41 | 41 | | the agency affected by the provision shall request the waiver or |
|---|
| 42 | 42 | | authorization and may delay implementing that provision until the |
|---|
| 43 | 43 | | waiver or authorization is granted. |
|---|
| 44 | 44 | | SECTION 3. This Act takes effect September 1, 2017. |
