55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the establishment of a pilot program to provide
88 services to certain persons with Alzheimer's disease and related
99 dementia enrolled in the Medicaid managed care program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1212 amended by adding Section 531.09972 to read as follows:
1313 Sec. 531.09972. PILOT PROGRAM FOR CERTAIN PERSONS WITH
1414 ALZHEIMER'S DISEASE AND RELATED DEMENTIA. (a) The commission
1515 shall develop and implement a pilot program to improve the quality
1616 of life and prevent the premature institutionalization of persons
1717 with Alzheimer's disease and related dementia who receive services
1818 from a day activity and health services facility licensed under
1919 Chapter 103, Human Resources Code, and who are recipients of
2020 Medicaid through a Medicaid managed care model or arrangement under
2121 Chapter 533.
2222 (b) In developing the pilot program, the commission shall
2323 solicit input from relevant stakeholders, including caregivers,
2424 advocates, Medicaid managed care organizations, providers,
2525 physicians specializing in dementia, and social workers.
2626 (c) The executive commissioner shall adopt rules for the
2727 implementation of the pilot program, including life safety,
2828 staffing, training, and programming requirements for the pilot
2929 program necessary to ensure that the specific needs of the pilot
3030 program participants are met.
3131 (d) The pilot program must be based on evidence-based,
3232 person-centered practices and ensure quality of care outcomes,
3333 including outcomes based on safety, effectiveness, efficiency, and
3434 equity, for the pilot program participants.
3535 (e) Not later than December 1, 2018, the commission shall
3636 report to the legislature on the progress of the pilot program.
3737 This subsection expires September 1, 2019.
3838 SECTION 2. If before implementing any provision of this Act
3939 a state agency determines that a waiver or authorization from a
4040 federal agency is necessary for implementation of that provision,
4141 the agency affected by the provision shall request the waiver or
4242 authorization and may delay implementing that provision until the
4343 waiver or authorization is granted.
4444 SECTION 3. This Act takes effect September 1, 2017.
